Your advice is just what she needs because the jurisdiction that matters is that of the US Immigration Law. She needs to confirm with the standard. I will like to ask what your opinion is about the column that talks about previous marriage, can she choose previously married when no marriage exists according the the US Immigration Laws? Or she would just say No, Never married? If she chose previously married then she would need to exhibit a divorce certificate. Pls what is your opinion on this?

That she tell the truth.  If the non marriage is the only marriage prior to the one in the new petition, she would indicate no previous marriage.  If she is required to formally dissolve the marriage, then she would list it and the dissolution.  What matters is the facts on the ground at the time of filing.   I/we do not know what hoops will need to be jumped through to accomplish a new marriage.  That is no a US immigration issue, except that they must jump through whatever hoops are required by the jurisdiction where they were married.

Facts are cheap...knowing how to use them is precious...

Referring to when she fills another Form I-130 after the valid marriage pls.

Hi im here again 

I contact a lawyer in UAE  he said he can get a marriage certificate after the divorce certificate date.

My husband divorce certificate is 2015. And the new marriage certificate he is going to obtain would be dated 2016 .

Im not sure about this, im scared to be question about this and looks like fraud 

Is this right?

What was the date on your original marriage certificate? Is that the date you got married? 

Is he saying he would forge a new document, with a new date?

The original marriage  certificate was 2012

Your plan will not work as it would be fraudulent to get a "new" marriage certificate with a different date.  Don't go down this road, find a competent lawyer in Morocco to resolve the question about whether you need a divorce according to Moroccan law or not.  If you do, get one, then get married legally somewhere after you have the official divorce decree and start on a new IR-1 process.  If according to Moroccan law you do not need a divorce, then just get legally married and start a new IR-1 process.  Was your visa denied at the UAE interview?  What did they tell you to do?  Start over with a new petition?  Unfortunately, you can't just get a fraudulent marriage certificate or you will make this situation worse.  Remember, US immigration officials have access to your file and all documentation submitted.  Never lie or you will dig a deeper hole.  Good luck!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hi Again i want to ask since im still in administrative process if i manage to marry again 

Is it possible that i can put this certificate in ceac with the explanation letter.

Is this possible  or in all cases i need to start the application again

Well your spouse would be the one who would need to file for you.

What i mean .since the decision not made yet and if i manage to remarry again can i still use it in the same application.  Or i need to wait until its denied  then start again with new application
