That's why you need a lawyer to figure out  in what steps to take/in which order. It seems like it's important to you, so make it right...

On the legal point of view, any marriage that is conducted while another legal marriage subsists, such marriage is void. Therefore, there is no marriage that exists between you and your husband. All you need to do is put up a letter to the Marriage Registry that your earlier marriage was done in error, that you were ignorant of the law that such marriage while another subsists is void. You should attach the old marriage certificate between your husband and her estranged wife and also the divorce decree. Once this is done the authority will re-enlist you for a new legal marriage and you will obtain a new marriage certificate. This is an ignorance and irregularity that can be cured with just an ordinary letter of information to the marriage registry. Good luck.

The problem we get married in emarat and uner the law there this marriage is legall and cant be corect as un error

We were married in the UAE and under their law we are legally married, however when i married my husband he was still legally married to his first wife who abandoned the kids and left the UAE. It was only after her return 5 yrs later to the UAE that the divorce was finalized.

The fact still remain that US won’t recognize the marriage certificate your provided. That means there is a need for an acceptable marriage certificate. My questions:

1. Where is your own country of Origin? 
2. where is your husband country of origin?

My husband he is usa citizen  and my country of origin is Morocco we meet in emarat and we been married there for 8 years we have 2 kids 

I applied from emarat and my residency expired so i transfer my case to Casablanca Morocco

Now this is the final advice I have for you. 
1. The marriage certificate of you and your husband will never be accepted in most other countries where they operate common laws.

2. You should remarry to your husband in your country of origins being Morocco and continue your immigration application with this new marriage certificate.

3. You can marry the same husband and the same wife in many countries of your choice provider you meet the requirements of the marital laws in that state and also your marriage will always remain valid as long as it is not a marriage with another woman or another man which will amount to a bigamy.

 

in conclusion, as a citizen of Morocco, you have the locus to marry in your country any man of your choice. Your present marriage certificate will not be needed in Morocco but once you are married in Morocco it means the marital laws in Morocco will start to govern your marriage.

 

however, you can also apply for a K1 visa to enable you travel and meet your husband for a new marriage with your hubby in the USA.

K1 and K2 visas will take you and your children to the US easily. If the child/children for your US citizen are his biological children and his name appeared on the birth certificate he can register their birth with the US embassy in your country and get their international passport. Your case isn’t a bad one and you just need to do what I advised and you will be good. You can also consult a lawyer in Morocco is you are unsure about my advice generally.
