JANUARY 2021 I-129F K-1 FILERS (merged)

I called today and followed the advice to continue saying "deadline for RFE" even though I didn't have an RFE and surprisingly I was connected immediately to an agent.  However, the agent was not able to help me at all.  He stated he understood the case was outside normal processing time but he had the same information in front of him that I did, which is that the NOA1 was Jan 27, 2021 and it is still being worked.  I asked if he could submit an inquiry on my behalf and he stated the same thing the website did, which is that you must wait at least 30 days after submitting an inquiry to submit a new inquiry.  He claimed his system simply would not let him submit it sooner than that time frame.

Yeah that makes sense.  If you try on day 29, their system will probably not let you do it then.  I guess my difference was my first inquiry was documents missing for the RFE and 2nd was outside of processing time and it was about 30 days later.  I still see it as a game though.  Don't lose hope on it!

My RFE response got messed up in the mail and was sent back to me which cause some delays. 

 

currently waiting to hear back on my response.

I-129F NOA1 :2021-01-08

I-129F RFE(s) :2021-09-28

RFE Reply(s) :2021-10-15

 

My RFE was on proof of meeting within 2yrs. I submitted itineraries and photo’s at first which was what they wanted clarification on. 
 

I ended up sending bank statements, passport stamp photos, boarding tickets, hotel receipts, and etc… 30 pages worth lol.

 

Which I should have done from the beginning :(. Hindsight 20/20.

I received the paper NOA-2 in the mail 22 OCT.  It does not really have a bearing on anything in the future, but at least I know it took about a week to receive from the notification.  And more than likely, they either sent it out Friday night or possibly Monday morning.  It definitely looks more official and I also realized it includes her alien registration number, which is pretty neat.  I kind of want to frame this because of the official look to it.

I received ours a few days ago too.  You're right, it looks and feels way more official.  Even the paper is heavier, right? 😃 Framing it is a good idea!

 

Hoping all those of you still waiting don't have to wait much longer.  Hang in there everyone.

  • August 9, 2022 = EAD (I-751 approved)
  • August 13, 2022 = EAD and SSN received (SSN applied with EAD)
  • September 6, 2022 = AP (I-131 approved)
  • September 13, 2022 = AP (I-131 receieved) 
  • March 15, 2023 = I-485 approved (interview waived, New SSN received without DHS wording)
  • March 31, 2023 = GC in hand (Total time from NOA-1 to GC in hand 794 days)

Our case is at NVC now and we actually got our case number last week. Can I go ahead and fill-out my DS-160 and submit it? Thank you in advance!

I'm not sure how backlogged the embassy is.  If my fiancee was asking me, I would say go ahead because Kyiv embassy is not really that bad.  Well at least start filling it out.  Then we would schedule time together on Anydesk to go over it and make sure it is good as far as questions/answers go.  Then submit once we have the green light.  I am not sure if it is a save and return type setup and how long it stays in the system, but that is my plan for her filling out her DS-160, which will hopefully be here in the next 2-3 weeks at least for starting.  I can check some other Canadian people based on your timeline to see if their time to Embassy was soon after the case was assigned or if it was delayed once lunch is all setup!

"The DS-160 is a document that stands alone. The DS-160 does not have a fee, and It does not
need immediate completion, but after you receive your case number and before the interview. The
case number is required to complete the DS-160, Online Nonimmigrant Visa Application. Once the
DS-160, Online Nonimmigrant Visa Application is complete, then you can schedule your interview.
Verify this with your P3 letter or others from your country. Most embassies require the DS-160
confirmation number to complete the payment of the MRV interview fee."

Thank you! I started filling it out. I think Montreal has a huge backlog too. Still hoping for our case to be in transit soon.

I am planning to send another outside processing inquiry in 2 days (30 days after the first one). I sent my first inquiry 9/27. 


Are you sending your second inquiry after 45 or 30 days after the first one?

I am sending after 30 days as well. 

 

Coincidentally we have the same NOA1 and inquiry date!
