Hi! My soon to be husband (US citizen) lived  outside US until March of 2019. His tax return transcripts from 2019, 2018 and 2017 show on the total income line amount of  $0.00 (i think it is because of the foreign income) but we have letter of his employer stating his salary was around $40, 000 annually. On his current job (from March 2019 until today), he is doing over $50,000, however we are wondering if it's better to submit 2020 tax and them submit I864 and I944 for the adjustment of status, along with letters explaining his previous salary, current one, job title, obligatiions, etc to show is not a temporary job and to avoid any possible inconveniences. Any experiences/thoughts let me know! Thanks

His current income at the time of your green card interview is what matters most.  No need to provide extra information about his previous (foreign) income.  For the proof of current income, submit employment letter listing annual salary, and/or pay stubs for the 6 months prior to filing.

Two different requirements.

 

1. Current Income: his current salary, can prove with employment letter and paystubs. This needs to be above the poverty line.

 

2. Latest tax return transcript and Total Income on latest tax transcript. This number doesn't necessarily needs to be above the poverty line.
