I apologize for the long post, but need to ask with the specifics to the situation. My fiance has had four denials, 3 tourist and one student visa. Two applications for the tourist visa while she was married to her now ex-husband, she only remembers the years of the application and interviews. The last two applications, one for a tourist and the other for a student visa, where filed since she’s been with me. I have the interview dates as I saved those emails. 

 

What information should I put in the box, classes/categories of visa with the approximate dates of the interviews, do I need an explanation with the denial codes? I worry about this one because when she went for her tourist or student visa the officer had asked her what her relationship to me was. She told that we had been friends but were no longer speaking terms. She had filed for the student visa, we then broke up and meanwhile had the interview. We started communicating again after the interview when she found out she was pregnant with our son. 

 

I believe the reason for the denial(s) was that she couldn’t demonstrate sufficient ties for her to return and a lack of financial abilities to support herself. She has one of the denial letters with the code. 

 

I realize I’m overthinking this one, but I’m not sure how to approach this answer for our specific situation, furthermore I understand that the officer thinks she might be desperate to get into the US. That’s something I’m not sure how to address if it comes up in the interview for her K1. Last year at the CRBA interview for our son, I asked the officer if we should apply for another tourist visa, the response was “No, she’ll just get denied again. Apply for the K1, it’ll be easier for you guys to get.”  I really hope that her previous denials will not be an issue.

Just put the visa categories and approximate dates of interview.  No need to explain the reasons for denial.  The CO will check your fiancee's immigration records anyway.

This is not an issue for K1.  The only thing you should worry about regarding her previous denials is if she was desperate enough to lie on those applications.  If there was no misrepresentation involved, there's no need to worry.

You're reading too much into the questions. Read the question carefully and answer with only what they are asking for. If you are foggy on the dates make your best guess. They will have all the dates from their systems. Adding too much information, especially that which is not asked for only can set you up for further adjudication either at USCIS or at the interview. Neither of which you want. When at the interview and are asked a question, answer the question short and to the point. Again, this will eliminate most further questioning. Look the CO in the eyes when answer and show some confidence in your answers. Also, "I don't know" is an answer and should not be avoided if the beneficiary doesn't know the answer. That is much better than to try and make something up that is or isn't close to the truth. 

 

With regards to the previous denials, you'll find many on VJ that have had the same situation as yours and they had no problems with the denials. If the reason for the denial was that the person offered fraudulent information than yes it will be the "deal breaker".
