Timeline

I just received a request for initial evidence for the affidative of support portion and I am very confused. All the information they are asking for I have submitted, and had an immigration consultant help me fill out the forms. I have attached the letter below. so frustrating .. also at the bottom are they requesting the I-944 at this time too?

Re-submit the joint sponsor documents. Sometimes things get unorganized at the Lockbox.

Yes, also submit I-944 with its associated documents. You live in Florida, so the recent 9th Circuit decision doesn't apply to you:

Yes, also submit I-944 with its associated documents. You live in Florida, so the recent 9th Circuit decision doesn't apply to you:

Thank you!  That is frustrating. So basically they misplaced that entire document and that’s why I am getting this letter?

So should I wait until he files his 2020 taxes? And omit the joint sponsor completely? Or how should I go about this ..  I know I only have 87 days to send everything in or my case will be denied

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Your husband can legally file a 1040 for 2020 after January 1, 2021, however the IRS typically does not start to process them until late January.  That said, I recommend that if he has all his required documents to file (1099s, W2s, etc.), go ahead and file a 1040 in January and also do a new I-864 showing the income for 2020.  Carefully follow the I-864 instructions for self-employed, there are slight differences.  Send the new I-864 and supporting financial documents (copy of 1040 plus all attachments) for your husband with the requested I-864 and supporting financial documents for the joint sponsor father in law, plus the I-944 in response to the RFE.  Good luck!
