ROC WITHOUT A LAWYER

Hello, I filed my AOS with a lawyer 2 years ago, but now I don't have money to do my ROC with the lawyer. Can I file by myself or uscis has on file my attorney address and I won't receive paper communication? thanks for your answers

All you need to do is to follow the instructions of the forms. Lawyer does that for you and collects your money. 

 

It is not difficult at all when you follows guides and instructions.

We did both the AOS and ROC without an attorney. No problem with i485 and still waiting on our i751 filed in May, but so far so good while waiting for it to be fully processed. The I751 form is not complex or even all that long I think most people who can follow instructions can fill it out successfully.

 

Go to the USCIS web page and download the instructions and follow them carefully. You download the current i751 form PDF and fill it out on your computer.

 

Remember, the green card holder is the petitioner & the beneficiary, and the US citizen spouse (or LPR spouse) signs the spouse section if you are still married (standard joint i751 application). [Must file joint i751 petition within 90 days of the expiration date of the conditional green card]

You if you can't file with your spouse your need to file an i751 waiver application due to divorce, death, abuse... (You can file a i751 waiver case anytime)

 

Print out the i751 application and have the CGC petitioner sign and the spouse sign if needed (joint application)

enclose the current fee i751 + biometrics fee  pay with check, money order or you can use a credit card if you add the g-1450 form https://www.uscis.gov/sites/default/files/document/forms/g-1450.pdf

 

Check the current mailing address on the USCIS website either USPS PO box address or UPS, Fedex street address depending on how your ship it to them.

 

(Note need this proof below if you file with a lawyer's help or not)

You need to attach proof of your bona fide marriage proof you and your spouse live together and comigel money together.  

Joint tax returns and IRS tax transcripts (available to download online)  for each year of marriage.

Statements from joint bank accounts & Credit cards showing money being deposited and spent on joint expenses over the course of the marriage

W2 or 1099 issued during marriage (shows both joint income and addresses) 

Copies of drivers licenses or state issued ID with common address for petitioner and spouse

Birth certificates for any children together

Joint insurance divers, health, life

Copies of joint bill together (Energy, phone, internet, water)

Photos together with spouse at family events, vacation, with family (just submit photos(s) on page no photo abamus must be scannable)

Proof of travel together during marriage: receipts, tickets interneraries 

Joint lease, or joint mortgage, or letter or affidavit from landlord that you and your spouse live together at your home address.

Affidavits from family or friends that can attest that you and your spouse are married and you live together as a couple. 

You can add mail received addressed to each of you at your home

401k, investment accounts and insurance  where spouse or petitioner are listed as beneficiaries  

Joint car registration

 

You can add a cover letter that explains the evidence enclosed  and any special circumstances with your marriage to make the evidence easier to understand (optional)

 

You are not required to submit everything listed above but as much as you have, if you fall short in one area of proof then provide more proof from other sources.

As for your question about an attorney getting your correspondence if you fill out the i751 application yourself no they will not.

 

The i751 form in part 10  covers if you had a perapirer prepared your i751 form and if question 7d is unchecked (if prepaire is a attorney) then your correspondence and the green card will go to your mailing address you fill in. (also no form G-28 form will be submitted with i751)

 

It is part of the i751 form whether or not you have an attorney so any action on ROC is dependent on how the i751 is filled out, no attorney listed and no G-28 included then all USCIS correspondence will go to your mailing address..

It seems overwhelming at first but it's very doable. Search the forums and you'll even find drafts of cover letters and table of contents that you can use. ROC is a separate process from AOS and if you file without a lawyer this time, all the correspondence should come to you.
