I-751 Application - Need Help

Our I-751 application journey has been really stressful and need any advise who had been in the same situation. Details and timeline below:

 

- Oct 7th - USCIS received our application

- Nov 12th - application rejected due to early filing received the returned packet

- Nov 14th - resubmitted via Fedex

- Nov 16th - received by USCIS 

- Dec 3 - called USCIS to follow up asked to call on Dec 17th as they can't request for a service ticket if application is 30days or less 

- Dec 18th - called USCIS, my resubmitted packet is still not in system, cashier's check not cashed yet, spoke to tier 2 officer and said that if check is still not cashed, cancel check and refile. So devastated by this and so we refiled

- Dec 22nd - 3rd filing received by USCIS 

 

We haven't cancelled our 1st check yet just in case its just a long delay. Its been 42 days now since our 2nd filing. 
 

Any help or advise is appreciated.

Something seems to have happened with the I-751 processing times after October. In the November 2020 filers thread there’s many of us who haven’t received the receipt number/extension letter yet. By the dates reported it looks like the last day of packages were processed were those that arrived November 12. After that they didn’t process any before Christmas. Our package was delivered to the lockbox on November 13 by UPS and still nothing. I contacted USCIS via the chat function on the website (there’s a thread about that), but only thing I gained from that was not having to listen to waiting music for an hour and an e-mail address to the lockbox.

 

Someone with more experience may want to comment what happens if the same package is sent to USCIS multiple times.

Getting there, slowly but surely...  (I hope )

Biometrics Appointment Received by Mail...too bad I am in Europe right when it's supposed to take place 🤯 6/14/2021

Rescheduled Biometrics Appointment, the biometric technician can't change the misspelled name on file, but he enters the correct spelling of my last name as an alias 8/2/2021

Interview Ready to Be Scheduled 10/13/2021

(Two Days Later) Interview Was Scheduled 😱 10/15/2021

I-751 Interview, Petition Approved 🥳 11/19/2021

Case Status Changed to New Card Is Being Produced 11/19/2021

Case Status Changed to Case Was Approved 11/22/2021

Green Card Arrived in the Mail (Name Correctly Spelling, w00t) 11/27/2021

 

When USCIS Misspells Your Name:

 

Typographical error form filled on USCIS website 1/4/2021
Contacted USCIS if there has been any progress since THEIR error (Received a Tier 1 tracking number) 2/6/2021
Contacted USCIS again as the issue remains to be resolved (Received ANOTHER Tier 1 tracking number) 3/12/2021
Apparently USCIS chat is worthless; CALLED USCIS, Tier 1 agent promised that a Tier 2 agent would call me 4/28/2021
Received a call from a nice Tier 2 officer who said I may or may not get a correct extension letter, but just in case I would be scheduled an InfoPASS appointment 5/4/2021
Went to local USCIS service center and had to deal with a nasty and entitled customer service agent who refused to give me an I-551 stamp. National Benefits Center is supposed to mail me another I-797 within 7-10 days... So I had to waste my day, taking buses for two hours one-way just to deal with this lady's attitude? 5/7/2021

After anxiously monitoring our mailbox for a few days I DID receive a corrected I-797, w00t! All documents good to go Vaccinated Ready to visit my parents in Europe for the first time in 17 months!!  5/13/2021

The lesson: Don't use the chat for anything complicated, AND keep hassling USCIS for a response...

Sounds like a repeat of April/May filers. I applied 04/17. This was in the midsts of Covid outbreak so everything came to halt. It took 62 days for me to receive my extension letter. There was lots of calling with tier 2 officers plus online queries, Ombudsman queries and finally got my congressman involved. USCIS claimed they sent it- but never did. USCIS also kept telling us to contact lockbox- nothing ever came of that. I did manage to get through to one person at lockbox via email which she told me nothing was ever sent and they do not reprint extensions. SO when USCIS state this- fight it! Because it’s not true. My actual print came from the service center on request by Congress. Completely sucks that this happening again. Don’t give up! You aren’t alone and I hope things get moving again after the holidays!! Its so strange with how screwed up it is to get it registered into systems. But there has been a few approvals recently with no interviews on theApril thread!

You didn’t need to resubmit a third package. Mine was received on Nov 16th too, so did many other VJers. We are hoping to hear back from USCIS next week since they last worked on the Nov 11th files before the Christmas break. No need to panic.

You end up with multiple, separate, concurrent filed I-751s....which all have to be adjudicated individually, or perhaps the additional ones can be withdrawn - but good luck getting someone to withdraw the correct one(s) while also realising you have others correctly filed you wish to leave.

Also no refunds.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Someone with more experience may want to comment what happens if the same package is sent to USCIS multiple times.

Seems like USCIS laid off a lot of people ( especially contractors)  working at Lockbox  in November  while applications as usually rolled in Truck load.  almost everyone who applied in November is having a significant delay in receipts
