Timeline

Just accepted a job offer which is due to start 23rd July.

My EAD NOA1 was 20th April so 23rd July is outside the 90 day deadline.

Question is do you normally get teh EAD within the time frame, and does the EAD allow you to work anywhere etc as the employer said they will need a number of the form or something when I start!

Anyone had experience, one hand im ecstatic about offer, other hand worried as I know what USCIS can be like

AOS and EAD Timeline

First Application rejected due to them not receiving $70 for Biometrics, even though I had a receipt from them :-(

NOA1 - 10/01/2007

Biometrics - Middle of October, don't have exact date sorry

I-485 and I-765 Touched - 10/23/2007

EAD Approved - 10/27/2007

Nothing Since

EAD allows work anywhere in the USA.

If has been more than 90 days to get EAD, schedule an info pass appointment and ask why.

The employer will need SSN, and see the EAD to employ you, the employer fills out form I-9 and submits it to USCIS.

The employer will need SSN, and see the EAD to employ you, the employer fills out form I-9 and submits it to USCIS.

From the I9 Form:

EMPLOYERS MUST RETAIN COMPLETED FORM I-9 PLEASE DO NOT MAIL COMPLETED FORM I-9 TO ICE OR USCIS

The responsibility really falls on the Employer. Some of them will accept the receipt as proof. According to the I-9, they should not, but they do.

You may want to contact your Senators and Congressional Reps, she if they can put some pressure on USCIS for your EAD

Perhaps you should read the I-9 handbook before making statements like this. I-9s are only checked by USCIS if they audit the company, otherwise the only requirement is to have the I-9 on file at the company.

Minor point of clarification: ICE, not CIS, is the entity that audits employers for compliance.
