Hello vjs,

Happy Christmas to you all. Thank you for your support and encouragement, after 2 years of filling uscis finally answered us. Please your comments and help will be needed as this journey has been so long, we need all the help we can get.

1.....We don’t have any children together yet due my wife is a sickle cell patient  and the doctor have advice we must be together before thinking of having children.

2..... I have never been married before and one of the reason we are in this situation today is because when I was in the uk I used a Causin of mine debit card to pay for my visa fees perhaps the reason they are asking if I have ever used someone else’s name or date of birth.

please vjs these are the 2 major places I am have issues regard what they are asking for. Your help and comments will be appropriated. we don’t want to make any further mistakes thank you.

No need to speculate what event in your past may have triggered the RFE.  USCIS listed exactly what they need from you, so provide exactly what they asked for.  As for birth certificates of children, state that you have no children born or adopted during your relationship.

Do you have your WAEC .. it has ur date of birth and name.. very good proof of identity.. Also ur voters registration card will do

For clarity purposes- The image you posted is for an RFE sent to the USC (wife) and you are Mr "O" the intending immigrant spouse (husband) right? For safety purposes please black out your name (everywhere its shown) in the images. If you can not edit the images please us the "Report" button on any post in the thread images so a mod can remove them and you can upload a new image with all instances of your name removed.

 

The RFE asks for 4 things. Its a rather specific RFE and I dont believe any of it would be triggered by simply using a relatives credit card to pay for past visa fees. Its important to be very honest not only with your spouse but with when posting for advice to ensure you get the correct advice and make the process as smooth as possible. Im not saying you did this- but it is very common for people to fib on past visa applications in an attempt to strengthen perceived ties. Some people also report using 'agencies' to help them apply and the 'agent' either encourages them to create ties or simply fills it out with incorrect information and you end up signing it with out realizing what you actually submitted. So please think hard about what you may have previously submitted- if you have copies look through them or attempt to obtain copies if possible...

 

The first thing on the RFE is asking about any children. You both do not have any. Either you filled out the 130 incorrectly or they have reason to believe you omitted the childs (or childrens information).  Again consider where they may have gotten this idea from because if you respond that you both do not have children and they still believe that is not true they will then NOID you and state exactly why they believe you do have children (ex NOID will state on X date you filled out Y and listed children named Mary Smith and Joe Smith)

 

Number 2 and 3 on the RFE is pretty straight forward. This may be a significant number of pages and thats fine. When presenting evidence like this IMO the quality of it is more important then the quantity. All photos need to be dated and include a description of who is in it. It can be helpful to match up photos with other evidences. For example a photo of the two of you at the Eiffel tower. Passport stamps showing you both traveled there. Hotel receipts and meal receipts while you were there. Emails or texts discussing the plans to travel. Social media posts or messages of the same. A text saying 'hey I just landed in Paris and am waiting by the luggage terminal C for you'. 

 

Number 4 seems to imply they believe the husband has used other names or DOBs and perhaps even has been married (traditionally or customary). Again please be honest with each other because if this is true it needs to be addressed and will not go away by continuing to lie or denying it. Perhaps someone used you as a tie (?) Ex they listed Mr O as their spouse in an attempt to obtain a visa and perhaps even entered his birthdate wrong. If so all you can do right now is submit the statement they ask for and if they are not satisfied they will NOID you and provide you with the specific reason(s) and information they have so you can refute it. 

 

Number 5 is common when births are reported late. They are looking for what is called "secondary evidence". You can google it for more information but basically its as described in the RFE. The more secondary evidence you can send the better. Hospital or medical records, school records, church records, census records, drivers licenses, voter cards. You can also submit affidavits (typically 2 are required). They can not be written by you. Ideally they should come from your parents (mothers carries more weight then fathers) If that is not possible then it needs to be from someone who has direct personal knowledge of the birth and the circumstances. A midwife or relatives are best but it can be a neighbor or family friend. Ideally they should have been an adult at the time of your birth but they can consider statements from siblings or cousins who may have been under 18 at the time of your birth (generally anyone who is over the age of 10 at the time is able to give a statement about your birth however they are not the ideal person to use if there are others to consider) Their affidavit needs to state their name, DOB, relationship to you, full information on what they know and how they know it. If the affidavit is NOT from you parents it should include why they are writing it instead of the parents. 

 

Number 5 may also be related to what they are asking for in number 4. In some regions its customary to add suffixes - in those cases they are simply variations of your name and not considered name changes in which you have to show documentation for. You do have to list the variations as 'other names used' though. 

 

There are some sample affadavits on another website- the ***removed*** one. It does not allow linking so use google. (website name +sample affidavit for one and the same person, website +sample documents for birth certificate for greencard, etc.)

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

WAEC is from high school so am thinking he left school before
