Hey Everyone 

 

After reading plenty of forums on F1-Reinsatatement on here and other sites, I believe I have no chance of getting reinstated but I'd still like to bring forth my case here and see what you guys think of my case. People seen to have profound knowledge of these kind of situations on here so I have some faith I'd learn something new if anything. 

 

A little background info: I came here for undergrad in 2014 in CS. Had my ups and downs, ended up changing major to Geography and minor in GIS in senior year after not doing so well( didn't spend enough time doing independent studying). Graduated in summer of 2020. Got accepted for Masters in Information Systems at the same school. Currently finished 1st sem and waiting to hear from USCIS about reinstatement. 

 

My i20 expired in dec 2019. DSO told me to get a letter from advisor explaining why I need extension which I did very well. Then DSO told me I need to clear off my dues for that semester and she would extend it. I did not have enough funds so I though I would extend it when I get funds in Jan before school starts. By the time, 30 day grace period passed and she told me to apply for reinstatement. It was her and my fault. She should have notified by a month before expiration date that I NEED TO PAY DUES ASAP and extend my i20 or it will be very troublesome. I screwed up by not keeping track of my status. DSO said my SEVIS expired in Feb 2020. 

 

Unfortunately I got in some trouble with law around feb 2020 I didnt breathlyze so they gave me DWI ticket. I got a lawyer and got everything dropped in Nov 2020. My 5 month reinstatement period was over July. I did not apply within that time frame coz of many reasons. Depressed, broke, family issues. I finally sorted courage issues and applied for reinstatement on Dec 21, 2020. I had all the documents including new i20 for master until 2022. I think the school also provided a letter recommending reinstatement. But given my situation, I think I wont get accepted. 

 

I cannot go back home to India coz I have big student loans that I need to pay. I have to finish my masters, learn CS since I care about education now. I do have a gf who goes to different school who I have been dating for a while now. I thought of AOS but given my situation, it will be deemed as intent to immigrate? I am not sure. We are legitimate and want to marry in future at some point.

 

Please let me know what can be done to help me

Reinsatatement is a no, very difficult to get approved. AOS is a yes, forget about intention, you are here already. So if your love is real enough for marriage, go for it then AOS. Good luck.

Thanks for the input Nancy!  Yes, I could apply for AOS. However, she is 20 and three semesters away from graduating. She wont't be able support me financially on the documents thats for sure. Lets say if I were to get married and file for AOS while I wait for USCIS to reply, wouldn't it seem suspicious that I am trying to dodge the system?

I don't see anything suspicious if it is real love. You can ask for joint sponsor.
