Hello Visajourney.

Two questions today.

  • I am currently on AOS with an expired EAD/AP which I had filed with my AOS. I would like to refile but do not know if I need to pay the fees this time, or if I had previously filed with my AOS that the fees will be waived again?
  • We have a trip to Hawaii coming up and since my AP has expired, am I still able to go without abandoning my AOS status? (I read in another forum that it should be okay since it is still part of the 50 states but I am EXTREMELY anxious because I have yet to see someone actually say they traveled there with no AP. So I guess I would like some extra reassurance).

Thank you.

Not sure about your first question, but you might try searching “renewing AP/EAD” in the VJ search Tool.  As to your second question, as long as your flight to Hawai’i is not connecting outside the US such as Canada, you are fine.  It is always a good idea to keep a copy of your AOS NOA with you when traveling even domestically.

Thank you! I wasn't sure how to search for it but you gave the perfect keywords and I got my answer!

It's free if you paid the full I-485 fee: https://www.uscis.gov/sites/default/files/document/forms/i-485instr-pc.pdf "If you properly file Form I-485 and pay the required fees, you may file Form I-765 and Form I-131 without paying additional fees. You may file these forms together, or if you choose to file Form I-765 or Form I-131 separately, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence that you filed and paid for Form I-485."

If you're being especially paranoid, note that all diversion options for flights from Hawaii to the mainland US are in Hawaii or the mainland US.

If your flight crashes in international waters, you have way more serious things to worry about than your immigration status.
