K1 Visa - Second Time application (Different Person)

Can somone please advise me if there is anything special we need to do when applying for a K1 Visa for a second time with a different person.

 

I applied for one a few years ago which was approved but the relationship was not succsessful.

 

I have a another relationship that started a couple years ago.. I would like to apply again for the K1 visa. I have all the paperwork ready to send in, but wanted to make sure if there was anything else I should do in regards to the application.

When you say a few years ago, has it been more than 2 years?  Also, when you say the relationship did not work out was that before or after your former fiancé entered the US?  The attached link may be helpful, but every situation is different.

It is possible to apply for multiple K1 visas. If you are the U.S. citizen petitioner for a K1 visa you can apply for a second K1 visa petition over 2 years after approval of your first K1 visa petition. If you want to file a K1 petition in less than two years, you will have to apply for a waiver for this rule. Google for this waiver to learn more.

There is or used to be a section about multiply filers on the I-129 just read the instructions, from what I remember it was pretty straight forward. If you need a waiver they are simple to make,  Some one can give you an example if you need.

Thank you for the info.. I was reading the part about multiple filer on the application and it appeared to be for restraining orders and criminal convictions.

 

The multiple filer section of the application was Part 3 (5a, 5b,5c and 5d).. None of those appeared to be for my situation, but I will research it more.

 

Application was recieved in January 2018 by USCIS

 

We were approved and she arrived with me in Miami January 2019

 

Married - February 2019

 

Filed for divorce - January 2020

 

Divorce Final - May 2020

 

I will google and research your link you sent me later this evening. It has been almost 3 years since the first application was received by USCIS.

So you're ok, no waiver needed since it has been more than two years since the previous I-129F filing date.

Thank you. She has moved to Miami and has not asked for nor will she ever ask for support...  I am not sure what process she will take to try to adjust her status and become a citizen.. It will be very difficult for her, we were not together long enough to apply for adjustment of status.. I can only wish her the best at this point.

I wish it was a happy time.. We arrived in Miami and stayed there a few days..with her family there.. then I had to go back to Michigan for work,, she asked if she could stay to see her family for a couple weeks because she hadn't seen them in 2 years.. They are from Cuba, I visited them there many times in Cuba and I also work for Delta airlines so travel is not an issue, the problem is the day after we got married I found out that she had an ongoing relationship the whole time we were together and that person now lives in Miami... so I had no choice but to let go.. I could not move forward and we both decided to divorce right away..

 

We did not get to spend much time together here in the U.S... I could not move forward to file for the adjustmetn of status and she agreed that would be best.

 

Yes, While the divorce was being processed I traveled to the Philipines a few times where I met my new Fiance, and she is aware of everything that happened.

 

We would have prefered to get married in the Philipnes and do the spouse visa, but unfortunetly I am not able to travel there to make that happen currently... 

 

I have already built a house there and will our travel benefits from Delta airlines we will be able to travel back there plenty of times each year once the borders open back up.
