Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You can not bring her to the US as your adopted daughter since the adoption was not completed before she turned 16.  Attempting to bring her as your adopted daughter will only be a waste of time and effort.


You can bring her to the US as your stepdaughter since your married mom before her 18th birthday.  This is the easiest way.

Go hire an immigration lawyer.  Her situation is now muddled with a birth certificate with you as the father.

I came to VJ looking for advice and answers. I feel I presented a very accurate picture of our needs and goals. I tried to present evidence supporting my beliefs and understanding of US immigration law, as if pertained to our very specific set of circumstances. Instead of finding people who would be supportive of my family during this process, I left feeling a lot of self-doubt and anxiety that I somehow made terrible choices that might affect my daughter's future. I, like you all, love my family with all my heart. I would never intentionally deprive my daughter of any potential benefit to her future, including the right under US law to citizenship as my adopted daughter.

 

I realize all the comments I received were only advice and were given with the best intentions, but may I give you some advice? Read what the posters are telling you. I mean, really read it. Do not get stuck in your own point of view. You can cause real damage. If I had heeded your advice and filed a stepdaughter petition, I would not be here where I am now in this process. I know I am racing the clock with only 5 months left to go, but it seems I am well on my way. I'm not ready to declare victory just yet, but this email from NVC really makes me feel I have made all the right choices.

 

Again, I do thank everyone for their advice. But, just listen to people. Please.

You were listened to.  Listening to you does not mean having to agree with you.

The notice saids your daughter MAY be eligible for the CCA.  The NVC doesn't make any decisions.  The US Consulate will make the determination whether the adoption meets the before 16 years old deadline.

Just a quick update. My daughter had her expedited interview this morning at USEM. At the end of the interview, she was told she was APPROVED, that no affidavit of support is required since she will immediately obtain citizenship upon admittance as a LPR, and will receive her I-551 stamped passport within the next few days.

Congratulations!  Happy to hear the good news although I have already known your petition will get approved by USEM as they have always honor the 🇵🇭 adoption law (retroactive date of adoption to the date of filing).  Thanks for the update and have a happy  family reunion. God bless po.

Thank you very much. I have always believed that we were on the right side of immigration law with our case. I'm very glad USCIS, NVC and USEM all were willing to expedite. Good luck to you too. God bless din po.

I couldn't figure out how to make a 2nd timeline for other family members so here is my timeline for the IR-2 visa,. if anyone is interested.

Today, my daughter received her PH passport with her visa stamp. Monday they will do CFO-PDOS, then we will purchase her airline ticket.
