Will do. And, I really do appreciate everyone's advice. We are a bona fide family. I hope they will see this and approve our petition.

 

If you read the full concurring decision of the BIA on July 8, 1985 it is clear that my family will be given consideration. If not, we appeal.

Even without an appeal, given processing times plus visa queues the chances of her entering the US before she turns 18 in October are fairly low imo. An appeal makes that almost impossible. Even if you get her in as an adopted child, there is probably a reasonably high chance she may still have to end up naturalizing by herself.

They said they'll let me know within 5 business days if they agree to expedite her petition.

When immigration involves international adoption, it really is not a DIY case.  You absolutely need legal advice.

Yes.  In the context of US immigration, there are many other laws that govern adoptions, as evidenced by much of the feedback you've received in this thread by aaron, SusieQQQ, and others.

Interesting update. My NOA1 for my daughter says National Benefits Center, but the status originally said Nebraska Service Center. Any significance to this?

So, just a quick update to this:

 

1. USCIS denied my expedite request.

2. No case updates yet, to date. All we have received is the NOA-1.

So, another update to this. After the USCIS denied my initial expedite request, I requested again and it was approved. I have just now received the Approval Notice for the I-130. Her file now goes to NVC

 

My wife's has her embassy interview on May 7. I'm plan to now file an expedite request with the NVC for my daughter's visa. Hopefully, it will also be approved and she can come with her mom in June or July.

Well, my daughter's case was approved as of yesterday. Now on to the NVC where I will file another expedite request. My wife's interview is May 7.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
