what is a person's status referred to after they get their EAD/green card?

After AOS is approved? As my husband will need to show permanent residence for his employment on a ship down the road - so I want to know when he will be able to apply for his license by showing that he is a permanent resident

Thanks

When he received his green card, he will be a permanent resident with conditions, or 'conditional permanent resident'.

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

First EAD and Green Card are not the same thing.

After getting EAD, but before getting Permanent Residence card (green card) he is empoyment authorized, but not a permanent resident.

After getting the Permanent Resident card (green card) he is a permanent resident and no longer needs the EAD.

He can show he is a permanent resident after AOS is approved and he has the Permanent Resident Card.

cshell,

A person's status after their application for adjustment is approved is Lawful Permanent Resident. The status may or may not have conditions attached to it, either way they are a LPR.

Getting an EAD does not change a person's status. Their status remains what it was before the application for EA was approved.

A person will be able to show that they are a LPR when they receive their form I-551 Permanent Resident Card - the Green Card.

I recall reading that after 90 days have past since you get your NOA1 you can get an info pass if you haven't gotten your EAD. How long after getting the EAD does a person usually get the green card? As it seems that he will need the green card to apply for the z card from the coast guard to show permanent residency. This is all assuming that AOS is taking longer then then the EAD. I know that AOS can take up to 2 years. Als

Also when does a person get a I-551 stamp?

cshell,

There's no relationship between when someone gets their I-765 approved and when they get their I-485 approved.

I-551 is the Green Card. If someone is going to get a stamp in their passport as evidence that they are a LPR it won't happen unless they are a LPR - after their I-485 has been approved.

Let me see if I have this correct now:

If one applies for AOS and EAD at the same time - they are processed seperately.

Most likely the EAD will come through first. For the EAD/I-765 the person will have both an interview and biometrics. Following the person will receive an employment aurthorization card. There status of the person will remain the same. But what is the status called/referred to of a K-1 person who married and filed for AOS and EAD before the 1-94 expires? How long does it usually take to get the card following the interview and biometrics? Do you need to have the card in hand in order to work?

The AOS/I-485 will take 3 months to 2 years to process and there may be an interview. If there is one the passport will be stamped with an I-551 if approved. After the I-551 stamp is received a person has adjusted status and becomes a Lawful Permanent Resident (LPR). Following a green card will be sent in the mail but may be held up for name checks? Now yodrak said "The status may or may not have conditions attached to it, either way they are a LPR." If there are conditions on it what might that mean?

Am I beginning to get the whole picture?

cshell,

Yes, I-485 and I-765 are processed separately.

There is no interview associated with the I-765, only the biometrics appointment to get the photo and fingerprint needed to make the EA card. The EA card will normally be received within a few weeks of approval of the application (unless, as sometimes happens, the approval comes before the biometrics appointment).

The status of a person who has passed the period of allowed stay in the USA, and who has an I-485 application for adjustment of status pending, is 'pending adjustment of status'.

Someone who is pending adjustment of status probably does need to have an EA card in hand in order to work.

I-551 is the green card, not the stamp. The stamp is a stamp, indicating that one has LPR status - a temporary substitute for an I-551.

One will not be approved for adjustment of status until after all of the security checks (name, fingerprints, etc.) have been completed. Delay in completing the checks will hold up approval of the application until sometime after the interview.

The conditions on LPR status apply when the status is granted before the 2nd wedding anniversary. The condition is that the status will expire in 2 years unless the person applies to remove the condition during the 90 days prior to expiration.

You are beginning to get the picture.
