Hi,

I'm the wife of a US citizen husband. We have been married since one and half years and we both are living in my native country thorough out these time.  We are in nvc stage in cr1. We paid all of the fees and now uploading documents in ceac. I have many confusion regarding our case. My husband came here after finishing his engineering graduation(from NYU). He never had job  and never filed tax return while he was doing his study and living in usa. Recently he filed 2019 tax returns(got 1040) from here. There he showed himself as freelancer engineer and his net income 3000 dollars. We added a joint sponsor who has enough solvency to sponsor me. We collected all the documents( i864,1040,w2, paystubs and for domicile two months utility bills) for the joint sponsor.

My questions are all about the main sponsor. 
1.How we should proceed now in ceac for main sponsor i864? 

As far as I gather that we must provide Main sponsor i864. How we should fill his i864? He has only one year tax return ( only 1040) and that too with only 3000 dollars net income. Do we have to give w2, proof of income etc? We are planning to fill i864 just the way it is. And then give AOS document, just 1040 of 2019. Do we need to give any explanation or any kind of writing in i864? We added a joint sponsor so main sponsors shortage of income or documents doesn't matter or there are more things to provide?

I can understand main sponsor domicile could be a problem to establish. But for the ceac stage we can upload main sponsor driving license.( also Bank account information of Bank of America, credit card etc but there are no transaction recently but credit card renewed) Once nvc stage complete and my consulate interview time comes my husband could get a job offer of a US company, lease agreement etc so that I could submit those in embassy. But we want to move together from my native country. 

Amy kind of advice suggestions will be greatly appreciated.

You can simply state that he did not meet the requirements to file.

my husband went to usa in 2019 November for jury duty. We have a jury summons where his name and mailing address are written. Can it be included as domicile?

Oh ok. Then I shouldn't give the 1040 for 2019? Just fill the i864 and submit in ceac.

Include an IRS tax transcript for his 2019 US tax return with the I-864, and include an explanation that for prior years his income was zero so no he did not need to file.  If US domicile becomes a problem later in the process, he may have to return to the US before you do, to establish a US domicile.  Good luck!

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Is the petitioner now in the USA working?  If not, sounds like you'll also need a qualified joint sponsor.

Yes we added a joint sponsor.
