One other thing, if you can prove extreme emotional abuse or physical abuse to you then you can file an abuse waiver i751 petition alone without your spouse and you don't need a divorce. 

 

I not familiar with the extreme hardship waiver so I don't know what you need to prove but that would also be an i751 waiver you can look to file without a divorce.

 

With all waiver cases you need to provide proof of a bona fide marriage up to the point of separation and proof of the conditions of the waiver covers: abuse, spouse death, divorce, or extreme hardship.

 

If you are going for an i751 waiver getting an good immigration attorney would be a good idea.
