Hi Folks,

 

I have been sent an RFE, and they want a I864 for my spouse (who is the US Citizen sponsoring me, I'm K1 doing AOS) and the I944 (which wasnt needed when I sent my application in due to covid, but now IS needed even though the covid situation is worse now than ever) . We live with her parents, and her father and his income are the primary sponsors (A good way above poverty line), my spouse just recently got employed again for the first time since the start of covid. My main question is what do I put for her annual income in the 864? Do we extrapolate based on this weeks earnings or do we put what she has on her 2019 W2?

 

Also in the i944, where it asks about healthcare: I do not have a healthcare plan, except for restricted scope medi-cal (emergency medicaid). How should I be answering?

The spouse is always the Primary Sponsor.

 

Your father in law is the Joint Sponsor.

 

Annual Income is the money she receives in a 1 year period based on what she makes now. So it is yours spouse current salary or hourly rate * hours per week * 52. It doesn't matter when she started the job.

Ah gotcha, sorry I mispoke about who is the primary sponsor etc. It's correct on the paperwork I'm pretty sure. 

 

So we just calculate it based on the 1 week of work she's done so far? Thank you for the help

You calculate based on what's on her contract. If she was hired to work 40 hours/week for $20/hr, her annual income is: 41600.

She doesnt have a contract though, and how many hours a week she works is subject to change

Is she self employed? If not, what would she provide to prove her income (like employment letter/paystubs)

 

If she's self employed, then it would be a different calculation. 

 

Anyways, you have a Joint Sponsor, so I believe it wouldn't really matter how precise you are as long as you send the form and the latest tax return transcript.

She's not self-employed. She just began working as a dog-walker for a small company, literally only a few days ago. 

 

That's true, I just don't want to be in trouble for inaccurate answers

Include her recent pay stubs, a letter from her new employer stating hourly wages/salary, anticipated future hours to be worked, with the I-864 for her as proof of current income.  For health insurance, just put down what you've got, the details of the catastrophic medical insurance you described.  Good luck!
