Petitioning minor sibling when parents' IR5 has been approved

HI!

 

When I petitioned my parents, I can only support 2 more dependents. Now that I am married, me and my spouse can now afford to add my sister. My parents' IR5 has just been approved (no interview date yet). but when I filled out the papers (initially), I did not include my sister due to my income. Should I just wait for my parents to petition her when they get here? Or there is still a chance she can go with them?  She is 13. What does the process look like?

IR5 cannot have derivatives, so there is no other option but to petition her separately. It will be much faster for your parents to do once they get here (approx 2 years after they file) than for you to do as a sibling (approx 20 years for Philippines). If someone needs to stay back with her, one of your parents can get a re-entry permit after getting their green card which will allow them to stay outside the US up to 2 years.

As @SusieQQQ mentioned, your sister can't immigrate at the same time as your parents. But can you confirm that she was listed in the 2 Form I-130 (Information About Beneficiary's Family) and the 2 DS-260 (Family Information: Children)?

Hi @HRQX! Yeah! I put my sister's name on it but I didn't say that they will come here too during the time I filled it out

Hi! What's the significance of doing so? Would it be easier to get her because her name is on the forms?

Many times if a "family" member suddenly appears it can be suspicious

The forms asks for all children to be listed. So first if they are not there have been false declarations under penalty of perjury that the forms are correct, and secondly leads to suspicions about who the supposed child actually is if one suddenly appears out of nowhere.

It's biographical information on the beneficiary that is required to be disclosed as part of the immigration process. 

Giving accurate biographical information doesn't make it easier to petition for her later.  Not giving accurate biographical information can make it harder to petition for her later.
