Worried K1 visa co sponsor will be declined - australia

Hey guys, 

 

My partner doesn't work and we are relying on her Mother being our co-sponsor. My partner has never filed any US taxes either. Her Student visa here in Australia ends in at the end of 2021 and she will be returning back to the states then, we are hoping that the visa will approved by then (yes high hopes i know). I've seen heaps of people being denied their K1 visa even though the co-sponsor earns double over the threshold and i'm stressing as i do not want to let this happen in the process.

 

What is the likely chance that this will happen to us? I know the Sydney Embassy accepts co-sponsors although i know that the form I-134 has almost no legal weight which is often the denial in this recognition which could leave me potentially ineligible for the visa. My partner has no cash assets or any what so ever.

 

I've explained in my previous posts about not going down the CR-1 visa due to cultural and family reasons. I would really prefer as much advice on K1 visa topics or any other solution about getting married together in the states. Thanks so much for everyone's amazing advice.

No on with any certainty can say what will happen to your case as it is being adjudicated by USCIS and your embassy. Each case is different, and each one who applies can have a different outcome then others. You should be a part of the conversation for your region/country here on VJ in the sub-forum for your embassy. To find your sub-forum go to the blue ribbon above, select "forums" then scroll about three-fourths of the page down and select the region that most represents where your country is located.  

 

If your fiancé is a student and is graduating with a degree, then it will be assumed by the CO that she is employable and will not have a problem finding a job. Most embassies will use a co-sponsor, but they look at the totality of the financial evidence for a given case. Yes, some have not been so lucky as to receive an approval but there are MORE that have then that have not.

The income of the co sponsor will be key in your case if Australia accepts co sponsors, since your partner doesn't work and has no income.  K-1s are not often denied in Australia so if the co sponsor's income is high enough you should be just fine if everything else in your file is good.  Good luck!

When I filed for my K1, my husband barely made any money and we were lucky enough to have a co-sponsor who makes about 8x of what he made in a year. He'd also never filed taxes as he wasn't required to, so we included a letter, signed by him, explaining why he had no tax returns to show. They never questioned this and we were approved. Yay that’s amazing! My partner and I have decided to go down the CR1! This visa causes too much anxiety so we thought I’d be the safest. Thanks so much for your advice

Completely understandable, looking back I sometimes regret my decision of going with the K1 visa because I'm currently waiting for my EAD and I'm so incredibly bored, I just really wanna work 😂 Wishing you the best of luck with the CR1!
