I have received my I-797C NOtice of action. They will schedule me for a Biometrics appointment soon. My Canadian Driver's License will expire in August 14, 2007. I need to get a Georgia Driver's License before then. The GA dmv requires a social security number. However I don't have one yet. Will the receipt (I-797C) be enough for them to help me get a georgia license? I need help.

Tennessee, where I am, also require a social security number to get a driver's license. A receipt is not a social security number, and will not suffice. To be sure, call your local DMV, but if the requirements say a ssn is needed, then it's needed.

I dont have one yet. I just recently got married and filled out all forms to get permanent residency. The INS sent a receipt (notice of action I-797). Case is pending. I didn't get my EAD yet or any other response to the other applications i filed. I heard that you can't get a social security number without an EAD. That's what happens when you rely on what you 'hear'... if you entered as a K1, you only have to wait 2 weeks before you can file for a SSN. David entered on 10/16/07, we filed for an SSN on 10/31/07, and he had his SSN 2 weeks later.

"Information for non US Citizens

To obtain a Georgia driver's license or identification card, a non US citizen must present one of the following immigration documents that prove legal presence in the US:

1. Valid (not expired) passport with I-94 or I-551

2. Temporary resident alien card

3. Permanent resident alien card

4. Employment Authorization Card

A Georgia driver's license or identification card may be issued with an expiration date that matches the immigration documentation expiration date, but no longer than 5 years. If there is no expiration date on the immigration documentation, a license/identification card can only be issued for a period of 1 year. The cost of the license/ID is $20.

A non US citizen must present their immigration documentation every time service is requested pertaining to a driver's license or identification card. This includes renewal, replacement or name and address changes, as well as all other transactions performed by Georgia Department of Driver Services."

I'm 100% sure that you don't need an EAD to get your social security number. You only need your VISA K-1 a Birth certificate and the I-94 form. I get mine BEFORE I was married. I had the EAD (the one sealed in the I-94 at New York airport) though, but in the letter I received with the package that came with my K-1 VISA .. they said that I should get my SSN two weeks after I get into the country.

Just adding my husband's experience; he came in as a visitor from Canada, so he has nothing but a passport. The Department of Motor Vehicles in Virginia said they won't issue a driver's license until he has an SSN or an EAD, and the SSN office won't issue him a number unless he has an I-94, EAD or green card. It's like ring around the rosy here.

The only good news is that 1) his Canadian license won't expire until November, so we hope to get his EAD sooner than that, and 2) the DMV did say that he most likely won't have to take any driving or written tests if he already has a valid Canadian license. Sadly, he has to surrender the Canadian license when he gets a Virginia license.

"For those drivers who are not citizens and not authorized to work in the United States, you will need to obtain a Form SSA-L676 'SSN CARD DENIAL NOTICE' from a local SSA office before visiting a DDS Customer Service Center to apply for a driver's license. You may contact the SSA at (800) 772-1213 or visit their website at http://www.ssa.gov/onlineservices/ and select 'field office locator' to find the SSA office nearest you. Form SSA-L676 is not available from the web site. After obtaining the form, please bring it to the Customer Service Center when you apply for your driver's license or identification card. In addition to the form, please remember to bring your valid passport and valid I-94 permit, and proof of Georgia residency. You will be required to surrender all foreign driver's licenses (if applicable)".

This letter says that you are "illegible" to get a SS card. I got one in SSA office in another state and it's really simple. Good Luck!!

I too have a question about the Georgia regulations.

We used a K1 visa, and we applied for a SSN about 2 weeks after she arrived. We had to get a SSN to put her on the bank account; which we could use to prove residency. N. finally passed her written test down at the DMV today. Unfortunatly, a sharp eyed employee there noted her I-94 expires on July 30; so her learner's permit expires then also.

For a non USC; the state of Georgia requires one of the following:

1)Foriegn passport with appropiate immigration documents

2)I-551 Resident Alien Card

3)I-668 Temorary Resident Alien Card

Any suggestions as to what I can get to show the DMV folks? Will the NOA that we will get when we file for AOS work?

What about an extension of I-94? If she has to sit around the house another 6 months waiting on her green card---she will go postal!

ANY suggestions would be helpful!

In Florida, I was able to get my license with my NOA1 for my AOS application. It's worth a try when you have your NOA in hand. Good luck.

Come to Florida and get your license...it's much easier here. Like it was mentioned, you can get your license (valid for a year) with your NOA from the AOS.

My husband did - even though he has an SSN he didn't need it.

Good luck and I'm sorry you can't just cross the border.
