Expedite K1 interview for Medical Frontliner.

Good day VJ.

 

I would like to ask if someone here who works in a medical field (who is the petitioner) tried having their K1 application expedited (NVC stage).

 

My Fiancee (Petitioner) currently works as a Clinical Documentation Specialist in a Hospital in CA. Hopefully next year she gets matched in her Residency Doctor program and we are thinking if we can use this as a reason for our papers to get expedited.

 

Has anyone tried this?

First be sure you follow the guidelines for the request to expedite and that you meet their requirements. Anyone can ask for their case to be expedited but must follow certain criteria. https://www.uscis.gov/forms/expedite-criteria.  If accepted or denied neither have an impact on any other process toward a visa. 


1. For USCIS refer to https://www.uscis.gov/forms/forms-information/how-make-expedite-request

2. For NVC they expedite K-1 visas already.

3. For Embassies, an expedited request requires you to contact them either through email or a phone call. Most embassy don't grant expedited visas but only in the case of an emergency. Check with your embassy for additional details.

Benefit requestors may request USCIS to expedite the adjudication of their applications or petitions. USCIS considers all expedite requests on a case-by-case basis and requires documentation to support such requests. The decision to grant or deny an expedite request is within the sole discretion of USCIS.

Its worth a try, but unlikely to succeed.  We just got our K-1 and we tried to expedite several times since my fiance (the beneficiary) is a licensed MD in the UK and Poland.  No dice.  We even had Liz Cheney (my congressperson) try it...again no dice.  Finally I talked to the embassy about it...once again no dice.  Oh, we made one last attempt to get an NIE for her to travel directly from Europe to the USA getting the NIE due to being a doctor who can help with covid.  No dice (of course).  All of this is despite the language in the BS POTUS EO's and DoS website saying that they want healthcare professionals to come and will grant them exceptions. Its all just lip service, window dressing.

 

Your case is different of course since the USC petitioner is a healthcare worker...."maybe" playing that up and saying she needs her fiance with her during this stressful time of helping patients.  (on a related note, I can tell you that my fiance was able to convince the border guard in Poland to allow me an exception to enter poland this year largely due to her being a doctor and playing up that she needed me there)


Good luck!  Try and try again and be persistent (and sadly very patient these days with DoS).

What would be the rationale for expediting a K-1 for the petitioner's job?  That does not make sense.

The petitioner working in the medical field is not a reason to expedite.  

The only time an expedite is granted based on the petitioner's job is when the petitioner is in the military AND is being deployed abroad.

Well, if the fiancée in the US works directly with providing patient care and has an unpredictable schedule and needs help taking care of children, or other dependents, I have heard of a case where they were able to get a NIE exemption but I would guess it doesn’t happen very often.  The particular case I heard about was in Poland. Good luck!

But note that the US embassy in Manila communicated to another VJ member that they will consider the following qualifications for expedite based on the petitioner's circumstances --

  • Petitioner is an active U.S. military member with pending deployment.
  • Petitioner with documented medical issues who is currently in the Philippines and unable to travel to the U.S. without assistance from the K1 applicant.
