Let me give you all my timeline 

 

March 26 filed AOS paper work

 

April 9 receive notice for all three forms at my current address

 

Check case status once a week online for almost 300 days

 

Dec 9th check case status to see that on Dec 1 Notice Was Returned To USCIS Because The Post Office Could Not Deliver It.

 

Dec 9th Call USCIS hotline they say that it was a biometrics appt letter and  a tier 2 agent will call back in 48hrs since it is urgent, no one did

 

Dec 14th call back USCIS they say that someone didn't put a reason why the call was urgent so it was set as regular which means call back in 5 days, but she will put a new one as urgent.

 

Dec 16th my wife calls USCIS and they tell us that the letter sent was actually sent on October 23rd and that she has missed her biometrics appointment and " hopefully they can reschedule it maybe"


Dec 16th I call back USCIS and she says she cant see anything in the system of a missed appointment and that the second agent did not put our call back as urgent but Dec 18th will have been 7 days since the first call so a Tier 2 agent will call us.

 

Dec 16th filled out an E Request to have the document resent.

 

I am so frustrated !!!

 

Now my question is IF a tier 2 agent calls what is going to happen ??

 

Are they going to reschedule my wifes biometric appointment and re send a letter to us ??? 

 

If she did actually miss it in October are we screwed ???

What steps should I take now ?? It has been so tough and now the DMV says they cant renew her license so she can not even drive anymore, just sit in the house and be bored.

We missed the biometric appointment by three weeks.  We went in the next morning and got it done.  The only mention made of being late was one clerk joked “what made you come so soon?”  Otherwise we just were handled as usual.  Biometrics is handled with a group fingerprinted and stuff, no one sets aside time like for an interview.

 

Oh I re read and saw you didn’t get the document.  Maybe they can look you up there if you tell them it was scheduled but you don’t have the letter.

 

If you get a copy of the letter just take it.  They’ll probably just do it.

Awesome well that's good to hear, do you think they will still do this during COVID ??

I can’t say from personal experience, since I haven’t been there since COVID.  But I think it would be the same, having a biometrics appointment (current or past date) was all that was needed.  I screwed around with the phone reps at first too, which was a waste of time.  If the drive isn’t bad, I would say try it and spend less time than you would with the worthless phone system.  Either bring the letter copy or the status of your case printed out.  They just wanted to see we had something we needed to do there.

I would say that you are not screwed cuz your online status did show that it was returned due to USPS failed to deliver.

But  you do need to get a letter of notice, and you can only get the finger print done on the assigned appointment time during covid19

I was there 20min early and was told to wait at downstairs lobby... 

 

staying at home and be bored is not that bad. been doing that since March.. my bio appointment was cxl 3 times due to office closed down

in the same boat. It's so frustrating. Last time it was the RFE notice that was not received which we found was USCIS's error in printing the correct address. pretty sure the same happened this time.

Not sure what to do now. Have filed the e-request which asked to wait for 30 days again! Every little things is a 30-60 days push out and all we are asking as legal immigrants is at least a right to legally work!
