Hello,

 

I hope someone would be able to give me some information on delays in waiver recommendations by WRD. does anyone know about the reasons why DOS is taking so long for sending the documents for Sponsor views and then Sponsor views  to come back then WRD willl take forever to give their recommendation. I also have a court hearinhg for my asylum case in January. I came to US with exchange program which was funded by US government. Attached is my current status on my case.

They always take a while. Under normal circumstances up to 180 days they have the review and send. But with COVID who know how long this can take. Ask your lawyer about it (I assume you have one) 

NOA1 for I130 - Dec 10th, 2018

Filed for K3 July 8, 2019.

Expedited I130 September 8, 2019 still pending review

Expedited I129F September 28, 2019.

I129F expedite request was denied on October 1st, 2018. No change since. Still pending approval/denial

Well My waiver was denied, DOS issued me not favorable recommendation. 
 

If you came on J1 any fellowship or scholarship which was funded by US government or any agency then they require sponsor views, not in every case Dos request require sponsor views

I am really sorry. It is heartbreaking. Could you tell us more about your case, country, etc?

Hello Sam, I am so sorry to hear that the case is denied. You have such a long timeline and then this, I am very sorry. Would you please elaborate why the case was denied because my case almost has the same timeline and I didn't hear anything yet. And who gives sponsor views?

Well Department of State does not tell you the specific reason of the issuing “ Not favorable recommendation” they gave me general reason saying “ Since my spouse’s hardships does not outweigh their J1 program policy so that’s why are denying it”

 

I am from Pakistan , I came to America on J1 visa an exchange program which was fully funded by The US government. They took so much time 26 months and then it took me little over a year to submit my form get the documents and everything ready. 

If you came to America on J1 visa which was sponsored by either US government or any agency Department Of state will seek their reviews whoever sponsored like for example my scholarship was sponsored by Bureau of cultural affairs, department of State so waiver review division sought their reviews.

 

however, each case is different they might not seek sponsor views in your case it’s all case to case basis 

 

 

I hope you get yours approved. Vast majority of Waivers are are usually approved by DoS once you have their approval then USCIS approve the waiver if they don’t approve it then USCIS does not approve it.
