Hello, 

 

My documents were DQ from the NVC in August 2020. I am a Canadian citizen waiting for a consulate interview @ Montreal. I am in a very strict lease in my apartment AND an employment contract here in Ontario until July 2021. It would be so much better to transition to US after my lease and work contract end in July 2021. My spouse (An American citizen) agrees it is better to go after July 2021. If the consulate contacts me about an interview between January 2021 and June 2021, can I ask them to schedule me after July 2021? What is the process when they contact me?

Proceed with the visa process.......After the visa is issued, enter the US to become a legal resident.  Then, immediately return to Canada to finish your business......

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Most consulates allow the applicant to reschedule interviews

You can request to reschedule.  There is a backlog everywhere, I assume.

Note that the relevant date is the date of US entry. See 8 C.F.R. § 235.11(b): "Correction of endorsement on immigrant visa. If the alien is subject to the provisions of section 216 of the Act, but the classification endorsed on the immigrant visa does not so indicate, the endorsement shall be corrected and the alien shall be admitted as a lawful permanent resident on a conditional basis, if otherwise admissible. Conversely, if the alien is not subject to the provisions of section 216 of the Act, but the visa classification endorsed on the immigrant visa indicates that the alien is subject thereto (e.g., if the second anniversary of the marriage upon which the immigrant visa is based occurred after the issuance of the visa and prior to the alien's application for admission) the endorsement on the visa shall be corrected and the alien shall be admitted as a lawful permanent resident without conditions, if otherwise admissible."

I think I understand what this means. It sounds like this says, it's not the date of the interview, but the date that we cross into the US. So, if I do the interview April 2021, but enter the US in July 2021, even if our wedding anniversary is June 2021, there will not be conditions. 

 

I appreciate the options. Someone else also mentioned that I can cross into the US and come back. As long as I don't have to cross until After June 2021, then I am happy with the informative answers. They are extremely helpful. I will admit that I am crossing my fingers that I don't have to get the interview before Spring 2021, but we will cross that bridge when we get there.

Most likely the earliest interview would be around early February as interviews are typically scheduled 6 or so weeks in advance .  That would provide for an Aug expiration date.
