In search of advice

When I petitioned for my finacee's K1 visa I used the I134 and supplied the most recent tax retrun and subsequent W2 which meet the 125% poverty guidelines.

Now that he has immigrated, we have married. and he has appllied for AOS- the gov sent a notification for the need of initial evidence on the I864. I didn't submit the W2s

However as all of these events passed so did time as did new tax year as well

*Which is my problem and concern.

As a school teacher I earn 125% over the line and did for 2003,2004, 2005, however I didn't teach this last year so to travel and be with my finace and his family in France, which left me under the poverty guidlelines for 2006.

I do have my teaching position again for this year starting in August which will again put us back over the 125% guideline.

We asked his uncle, an US permanent resident of 23 years, to co sponsor and he agreed yet is VERY hesitant due to the liability of his home and assests. If perhaps my husband were to get in an accident and require extensive medical (god forbid), he fears a material loss too detrimental, which of course I concur.

I noticed that others had posted for clarification whether it is possible to relinquish his uncle's responsiblity as a joint sponsor later if I were to fill another I864 after the next tax year, and found it is not- that once gov accepts it stays binding.

Do I have possiblity to succeed without a co sponsor in that I have past documentation of my earnings and employement as well as future earnings and documentation along with the explanation of why I didn't this last year?
