This is not a interrogation and was not a question for you. This is a forum and for understand the whole picture I and everyone here can ask things. If the person don't want to answer is his right too. You can't tell me or anyone here what we can do. My question was not offensive or said in a derogatory tone. And again, was not directed to you.

I didn’t tell you what you can and cannot do. I told you my opinion (note the difference) which I am entitled to do. And telling me that it was not directed at me is irrelevant. Anyone can respond to any comment on here whether or not it was directed at them.

The period of overstay is irrelevant if the ban period is over. It might be relevant if OP was applying for a non immigrant visa but the only thing that would be relevant to a spousal visa would be if the ban period had not been completed.
