in 2003 when I applied for a UK visa (for the second time) I was asked about the person I claimed I was visiting on my previous application five years prior. I was ready for the question and told them the name and that he was a close family friend, a colleague of my father. The interviewer then asked how come five years ago I called him my uncle. I replied that in our culture every older close friend of the family is an uncle. He accepted the explanation and let that slide and issued me the visa, it could easily be refused on the basis of misrepresentation. Whew!

 

I hope you get this resolved. A good immigration attorney with experience in misrepresentation is suggested, I don’t know if you can get one in the USA to represent you, that would be my preference if possible.

O my God.now I remember. She stressed on a particular name asking who it was that I have him on my application.my brother and a family friend have the same name ,so it was my brother's name that came to my consciousness...on my previos application I have my family friend on it. I was meant to stay with him when I get to State.. Thank you .. this should be it. But the interviewer just said ok. I ddnt even state if it was my previos application she said it like it was this recent one. She also ddnt even act like I have said anything wrong

All you can do is ask the Lagos embassy for clarification as to what the material misrepresentation finding was based on, and get an experienced attorney who might be able to help you with a waiver.  It will be a long and expensive road.  Sounds like you have the previous visa applications, first one for a B2 tourist visa, second one for an F-1 student visa, third one for a spousal visa, all denied?  So compare all of your past applications and petition with supporting documents to see where the discrepancy is.  Something significant didn't match.  It could also be the case that in your most recent interview, you gave an answer that was not consistent with information in your most recent or previous visa applications.  Were you in a relationship with the same man in the US for all three applications?  Was your true purpose in applying for a visa to enter the US three times to visit him?  How much time elapsed between your three visa applications?  Maybe details about the previous applications came out in your most recent interview that did not line up.  Sometimes visa shopping can lead to problems like this.  All the best with finding a good attorney to try and overcome the material misrep ban.  If a waiver does not successful, is your husband willing to move to Nigeria to be with you?   Good luck!

This are the list of all the documents asked buy the interviewer not the one I was asked to submit to dhl after the interview

Ok. So after the interview they asked you for your husband divorce documents and something else?

The time you applied for the previous visas (B2 and F1) was you dating or engaged with your now husband? 

His ex wife is from Nigeria too? 

How long you've been marry?

Which years you applied for the B2 and F1?

 

(Sorry for so many questions, I'm and everyone here are just trying to get a better view about your case)

The divorce document was asked along with my marriage document but my marriage cert was returned to me not the divorce.  His ex wife is from Nigeria but shes in the US now. We have been married 3years

 

B2 was 2016

F1 was 2018

And his divorce was finished before the married you, correct?

Did your husband also sponsor his ex-wife for immigration?  Where did they file for divorce -- US or Nigeria?  How long after his divorce was finalized did you two get married?

Yes he did. They divorced in Nigeria. We got married a year after his divorce was finalized

If the ex had immigrated, it might have been suspicious that they went back to Nigeria for divorce, instead of filing in the US.  Is there any way for you to verify that the divorce was properly finalized in Nigeria?  I ask because there have been visa denial cases reported here due to fraudulent divorce papers.  Not saying your husband gave you fake papers, just suggesting to double-check that the divorce was properly filed.

Not saying this is the problem, but this might be part of it.

 

People living in the US must get divorced in the state where they live.  They can not go and get a divorce abroad, even if they are citizens of that country.  

You need a qualified US immigration lawyer to help you.
