I went for my interview on the 8thof December 2020,after showing all my documents the interviewer gave me a form ticking 2 more documents I need to send through dhl and also returned my passport. But the next day before I could go send the documents  I got an email attached a refusal letter based on Material misrepresentation.  Do I still go ahead and submit the documents.i am eligible for a waiver

Do you know what the Material Misrepresentation is?  Does the letter cite a specific 212 paragraph for the refusal?

No I don't.  It was just written in the letter Material Misrepresentation. "Please be informed that you have been found ineligible(6C1) for material misrepresentation. Find attached the refusal letter.

Note: if you attach an image of the refusal letter, make sure you black out any personal information.

 

212(a)(6)(C)(i) is pretty serious as they are saying you willfully misrepresented yourself in order to gain an immigration benefit.  What visa were you applying for?  Do you have any idea what the misrepresentation might be?  Common issues would be like not disclosing a relative in the US, claiming to be married on a visitor visa application when not, etc.

Immigrant visa for spouse. Sincerely I have no idea of any willful misrepresentation . All information given where the whole truth. How can I find out what it is excatly. I was still even told to submit my birth attestation to dhl so I don't know what went wrong

Which embassy did you have your interview?

 

Have you ever applied for a US tourist visa before starting on your spouse visa process?

Have you ever applied for a US visa before?  I would go back through all the information you submitted, and any past visa applications if you have applied in the past.  The biggest item we see from time to time is when someone previously applied for a B2 visitor visa, and then subsequently filed for a fiance or spousal visa and items on the DS160 and/or DS260 do not match.

I would submit all the documents they ask for.. I would also follow up to ask them about the misrepresentation.. so u can clarify

Lagos,  yes I have. I was asked just one question regarding my past application. And the question was who invited me?  in which o gave the name

No I didn't use any agent.. i filled all form myself.. my first application i was single and my second one i was engaged and now i am married

I was single in my first application which was a visiting visa  and engaged when I filled the second and that was even a student visa. Been trying to see where I could have gone wrong but I just can't find any
