I-944 to adjust status after K1

Hello everyone,

 

I successfully made it to California on my K1 visa. Few days after arrival my now husband and I got married. I had all my documents ready and now finalizing my packet but even after reading on visa journey I am still confused about the form I-944. 
is this form still needed ? I’ve read on an immigration attorney website that as of July 2020 it is not needed anymore and when I check the list of documents to submit with the I-485 petition on USCIS website the I-944 is not in the list but it is mentionne within the petition.

The attorney website is outdated since there's been many developments since then.

 

You said you live in California. It's still unclear how USCIS will respond to a recent court decision about Form I-944. On Dec. 2, the 9th Circuit’s decision affirmed the limited N.D. Cal. injunction: https://cdn.ca9.uscourts.gov/datastore/opinions/2020/12/02/19-17213.pdf

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Hey, I got an interview as I was under an exception to the current travel ban as I am the mother of a US Citizen. My daughter was born in france and shortly after her birth we went to the consulate for both her us passport and my K1 visa. Everything went super smooth and during the interview the agent confirmed my K1 was delivered only because I was the mother of a US citizen. Hope it helps!
