AOS/EAD/Driver's License Questions

Hi, I have a few questions that I haven't been able to find hard answers for. Would appreciate any insight.

 

I rescheduled a K-1 AOS interview in Dec 2019 from Los Angeles to Boston. The rescheduling was approved in April 2020 but I have yet to receive a date. Sept 2020 was the last time I spoke to USCIS over the phone and they didn't have any updates for me. I tried calling again recently but was unable to reach an officer because the robot first asks to provide a receipt number to check my case status and in my case it's outdated from 2019 so it doesn't put me through to speak with someone.

- Is this waiting time to get an interview appointment normal due to COVID? Could my case have been forgotten about?

- Is there a way to bypass the robot/say a magic word in order to speak to someone?
- My DS-3025 vaccination sheet expired Oct 2020. Would I need to do another medical exam prior to the interview?

 

I'm fortunate to not have to work during COVID and didn't plan on travelling during this time so I let my EAD/AP card expire in Nov 2020. I just found out that if I renewed prior, the fee would've been waived. 

- If I were to apply for a renewed EAD/AP card right now, would I have to pay the $410 fee again?

- I've seen people talking about renewing the EAD/AP card online but I cannot find this option on the website. Does this option no longer exist?

- Is it going to take 5-7 months to process the renewal?

My Massachusetts driver's license expires Feb 2021. The entry visa on my passport is expired as well as the EAD/AP card. I'm worried I don't have any valid acceptable form of identification.

- Assuming I won't be able to renew in time for Feb, would I be able to renew my license with some other form of documentation?

Do not repeat the question as your post here will be moved to that thread where others can opine. 1. Everything is delayed. Moving might also delay everything.

2. To get to talk to someone, keep saying Technical Difficulties.

3. There's no expiration on your DS3025. Idk where you get that from. Your foreign medical remains valid as long as you FILED for AOS within 1 year of the foreign medical.

4. EAD/AP were free when you first filed, and are still free now, because you have a pending AOS.

5. No option to file online. EAD renewals have been taking 1 to 2 months to get approved if they reuse your biometrics.

6. You should've thought about your DL when you decided not to renew your EAD. Remember that the EAD card is more than just a work authorization, it's the only immigration document you have before getting the green card.

No, renew your EAD Immediately. Massachusetts is very strict about this. Even when you have the correct paperwork you get a hard time due to their lack of training  and experience. Been dealing with them for 3 years.

Again? EAD/AP applications are free if you paid the full I-485 fee. https://www.uscis.gov/sites/default/files/document/forms/i-485instr-pc.pdf "If you properly file Form I-485 and pay the required fees, you may file Form I-765 and Form I-131 without paying additional fees. You may file these forms together, or if you choose to file Form I-765 or Form I-131 separately, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence that you filed and paid for Form I-485."

It never existed. You have to file by paper at Chicago Lockbox.

K or V Nonimmigrants Applying for Adjustment [26]

K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

  • The medical examination did not reveal a Class A medical condition; or 

  • The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27] 

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28] 

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician. 

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

Oops, I apologize for posting on the wrong forum. Thanks everyone for your replies, I'll be renewing ASAP!

 

I just want to confirm on the I-765, I put the most current I-94 entry info (entered back after visiting family using AP) and not the original entry from when I entered on the K-1 visa? Do I write K-1 AOS as current immigration status?
