Moving back to Canada after coming to the US on CR-1 visa?

Not sure if this is the right place for this question but it made the most sense. My partner is Canadian and I'm a US citizen, and we're currently planning to get married and apply for him to move to the US with me on a CR-1 visa.

 

We know we want to live in the US for now, mostly because of my job, but my question is: what if a couple years down the line we decide we want to move to Canada to live together there instead of here? Will that still be a possibility after him coming here on the spousal visa, and how would it work if we wanted to move to Canada together later on?

Hi,


After having a green card for 3 years, he can apply for US citizenship.  He would then be a dual citizen of Canada and the US and can freely live in either country.  Living in Canada, he would need to file a US tax return.  If he makes less than $100,000, then he wouldn't owe any US taxes.


If he chooses not to become a US citizen, then going to live in Canada would mean the end of his US legal permanent residency.  He would need to reapply for an IR-1 visa if he wants to come back to the US to live.

Thanks for the quick response! Does having the green card for 3 years include the 2 years of the conditional permanent residence status from the CR-1 visa? Or is that 3 years after the conditions are removed for a total of 5 years?

The 3 years includes the 2 years conditional green card.  Essentially, 3 years of having any green card, 3 years of marriage to a USC, and living 3 years with that USC spouse.
