Hi guys,

Firstly, let me thank you guys for running and helping people on this forum, it's been a huge help so far. Hopefully you can help a little bit more to help my wife and I get over the last step!

I was removed at entry ( 212(a)(7)(A)(i)(I) ) in 2017 and given a subsequent 5 year ban after attempting to visit my then girlfriend on a tourist visa. Although nothing was confirmed, upon reading text messages in my phone it gave the impression that I was attempting to move to the US to get married on the aforementioned tourist visa. We were married later on that year and my wife decided to move over to the UK to live with me here. She now has as UK spose visa and we share a tenancy here. Earlier this year, we sent off our I-130 application to start the proceedings of me coming back to the US.

I went for my I-130 interview last week at which point the consulate officer recommended we now send off our I-212 form, so here we are. We're currently in the process of getting our affidavits and documents together but the part I'm most worried about is the personal statement / apology letter that comes from me. Although it was not my intention to deceive the US government, it seems like it was so I feel like my wording will be very important. We've already spent a lot of money on this already and can't really afford a lawyer so have been doing this all ourselves. Any pointers that you guys have would be hugely helpful and we would really appreciate it!

Thanks in advance,

Chris

Any reason you did not file the 212 when you filed the 130?

Is this an option?

Yes
