Hello

I entered the U.S.(mid-April) on K-3 while the I-130 was pending. 3 weeks later, the I-130 was approved by VSC, which said it was being sent to the NVC. 2 weeks after the I-130 approval, I applied for AOS, got the biometrics done and a subsequent touch. Meanwhile haven't contacted the NVC at all. Today I just happened to call the NVC line and found out that the NVC has started processing the I-130 though I have not received any paperwork yet.

Would the USCIS(MSC) inform the NVC about my choice (ie AOS preferred over Consular processing) if the I-130 is already at the NVC? Or is that my responsibility? Several vj postings had suggested that USCIS would take care of this. Perhaps the timing did not exactly work out in this case.

a) Are AOS and NVC processing in anyway linked or completely independent?

b) Would the fact that NVC processing has not been stopped yet, impact the current AOS process? Would MSC make any presumptions?

c) What is the right thing to do here to stop the NVC processing without impacting the AOS?

Did you send a copy of the approval notice (NOA2) for the I-130 in with the I-485 AOS?

a ) NVC is part of DOS, and USCIS is part of DHS, so processing is independent.

b ) Again DOS has no connection to USCIS, so their processing should have no impact on the AOS case.

c ) Leave it alone, when NVC does send you anything you don't have to respond, and can abandon the CR-1 process at that point.
