I have never seen an expired K-1 appealed.  I'm not sure it can be done.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

this is when the embassy returns the K1 to USCIS  office from embassy

 

i never got a letter of denial but i have seen others that did get an answer for the reason of denial

 

anyway ,  this OP should not even try it as i have seen the Morocco embassy (2011) deny a K1 because the USC had a child out of wedlock/  even the crimianl report(s) both clean,  the admission of a child out of wedlock means the Moroccan broke their countries laws (not arrested but admitted) and the CO (an American ) said "you have no respect and honor your own country's laws,  how can the embassy expect you to honor USA's laws.

 

This American never followed thru with marriage or a visa and is raising child on her own

I've seen several K-1 petitions approved in Casablanca where the couple had a child together out of wedlock. I don't think that was the issue. However I do agree that getting married in Morocco and petitioning for the CR1 visa is the better option rather than attempting to fight for this expired K-1 or starting over with another K-1.

I am not yet convinced that an expired K-1 can even be challenged......I don't recall ever seeing that.

How do you appeal an expiration date.  Nothing about the decision is subjective.
