2020 I-864 Affidavit of Support

Timeline

When will NVC start considering 2020 income for I-864 Affidavit of Support? Due to unfortunate circumstances, the joint sponsor who agreed to support my application fell through because he did not file 2018 taxes. His 2019 income will cover the I-864. It is out of my hands to make him file 2018 income taxes.  I can get a co sponsor who has agreed, but he did not make enough in 2019 but will have made more than enough in 2020. When will I be able to put 2020 income in I-864. Again, thanks for helping me. :)

Current income is what counts.

Sponsor has to state that he/she filed taxes for the previous 3 years.  If he/she did not file 2018 taxes, he/she marks "no" and explains why.

 

Only the immediate last year of the previous tax return transcripts is required, the other 2 years are optional.  So, 2019 tax return transcript required, 2017 and 2018 optional. 

 

For Current income, sponsor enters the wages they earn now, projected in an annual basis (i.e. if making $1000 per week, then annual income is $52,000).

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

This is all technically correct but unless he has an acceptable reason for not filing in 2018, the explanation will not do away with the need to enter a number from the 2018 tax return.

Well, everything counts but Current Income is the most important.  For an employed person, current income does NOT come from a tax return.  It comes from annualizing the income shown on a pay stub.

I agree with you and everybody else too. I will ask the joint sponsor to file the 2018 taxes..because it was a previous year and I don’t even need those transcripts..sigh I just want him to check yes on that box instead of no for taxes. 

I backtracked and did not submit the joint sponsor affidavit on NVC. I’d rather wait and submit things properly and honestly.

It's not about just checking a box. You'll need to enter the total income number from the 2018 tax return.

Facts are cheap...knowing how to use them is precious...

Another question all, as I wait for this joint sponsor to do file his taxes which I understand takes time (considering he has to contact employers for his w-2). 
May I use another joint sponsor who did not make enough on his 2019 tax returns but currently makes enough (current employment and paystubs)

Yes.  Again, current income does not come from a tax return.  You are providing only a small piece of information about this sponsor though.  What about 2017 and 2018?  How long have they had their current job.  What you "can do" and what will work, are not the same thing.

Facts are cheap...knowing how to use them is precious...

It's not dishonest to say they didn't file taxes if they didn't.

 

in less than 2 months you can use 2020 returns.

Transcripts probably won't be ready yet, but you'll have the paperwork.

You are correct, it is not dishonest.  👍 

It’s just the sponsor did not have a valid reason to not file 2018 taxes. His income for that year was ~>$50,000. He does not owe taxes, (that’s for sure) he just did not file a return. 

I am trying my very best to also help this sponsor and said I could help him file the return. (He is also my brother and in the end it would also help me). Let’s see how this goes.

Hmm. This other sponsor did not make enough in 2017-2019. They have had this current comfortable pay full time job since July 2020. I know, everyone is trying to help. I will think about some things..currently am also trying to get a job, I hold a professional license in the US (in physical therapy)  I just moved back to US in november after visiting spouse. 

Appreciate it.
