My sister and I have the same father, different mothers.

When I become a citizen (long way off!), I intend to file for her.

Now the problem is, when she was born, her mother was so embarassed that she and my father weren't married, she put his name as being hers on the birth certificate.

Ie, her name was Jane Doe, my father's name was John Smith, she wrote his name as being John Doe on the birth certificate.

Now, what I need to find out, how do I show that she is in fact my sister?

I would assume DNA would be water tight, but was wondering if affadavits would be enough?

If they only accept DNA testing, is there a list of approved bodes that do this worldwide?

09/18/2020 - NOA via text

06/05/2021 - Notification of biometrics scheduled

09/17/2021 - Interview - decision cannot be made

11/24/2021 - Denial letter, 30 days to appeal

12/24/2021 - Appeal sent back with I-912 waiver

12/24/2021 - Motion to terminate deportation proceedings from 2013 filed

It is going to take a very long time for you to get your sister over here, the law at the moment allows for you to file once you are a Citizen.... so you will have to wait 3 years from when you are approved as a LPR then its going to be another 11 years + before a visa would be available to her so you are looking at 14 years or more.... you can read the State Dept Bulletin here http://travel.state.gov/visa/frvi/bulletin...letin_3258.html

If the current immigration reform Bill is approved then the class of immigrant that includes Brothers and Sisters will be removed and she would no longer be able to come here based on her being a family member....

As to the Birth certificate problem I would think you will need to get a sworn statement from her mother outlining why her birth certificate has the wrong name on it for her Father and you may need to get a DNA test done at some point if a visa becomes available....

Not in my case they don't....

It tells you what other document can be used if a birth certificate in not available or is incorrect.... but of course you could make an appointment at your local USCIS office and ask them.... you have penty of time to do this as it is going to be 3 years + before you can file an I-130 for your sister....

You can also contact the registars office in the UK to find out if it is possible to have here birth certificate amended...

But it is so long in the future it hardly matters, and hard to believe the regulations will not have been changed by then.

They have different mothers...

Might be possible to get the birth certificate changed - there's actually a minor error on mine and when we were filing the I-129F I was worried that I'd run into problems because of it. I called the registrar's office and they told me that it is possible to get a birth certificate amended (in the end I didn't bother, and it wasn't a problem) - if I remember right, they said I'd have to get my mother to write to them explaining what the error was and requesting that it be rectified. So your sister's mother or father (or both) might be able to get a new birth certificate if necessary, so you can show that you both have the same father...

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png
