Trying to start the process (any ideas?)

Hello everyone, 

 

Thanks for all the help in advance!

 

So, my situation is....

 

I have a fiance and son back in the Philippines (my son is 1 year 6 months old). Last year 2019, I worked in Taiwan so I could be closer to them and they could come to Taiwan for 2 weeks at a time. 

 

Then Covid happened and long story short, I came back to the USA in February. I have worked here since then and am going to make like $45,000 for the year 2020. 

 

I would like to bring my wife to the USA, but don't know the fastest way (the son is a different story as I have to do all that paperwork through the US Embassy in Manila, I believe). Also, I was planning to go to the Philippines in April, but they are not really letting people in unless you are married. I looked at getting married online in Utah and might do that next month (january), I am just not sure if that will mess up the immigration process. Also, since I have solid income for 2020, I know you need to show solid taxes for the immigration process to be accepted. I am open to staying in the US and working if that is what needs to happen for her immigration status to be approved. Right now I have not started any paperwork, but I am hoping to start soon. 

 

Are there any recommendations?

 

I am totally open to any ideas.

Assuming she will not be working a K1 fiancee visa, a year maybe less.

You can enter with a son in Philippines if he is under like 18, if over 18 he must have some type of disability

That marriage, even if legally performed,  would not be valid for US immigration until you have been together.  You would have to wait to start the CR-1 process.  You can either start the fiance visa process, or you can wait until you are married and together to start the spousal visa process.  Either process will take at least a year.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If I start the fiance Visa process do I have to be employed/working this upcoming year 2021, or can I just use my 2020 tax return?

 

If I do go to The Philippines I will still have income, but it will probably not meet the immigration process minimum.

Income requirement needs to be met at time of visa interview not at the very beginning of the petition

Generally, you have to have sufficient CURRENT annual income at interview time....or a qualified joint sponsor.  But, if I remember correctly, joint sponsors are not always accepted.  I defer to the PI experts.

So, if I am working at the time of the Visa Interview and have the paystubs at that time.... that is all you need?

For the most part, yes.  Prior tax returns or tax transcripts may be requested, but the most important to demonstrate the amount of your current income

What's the current policy on Joint Sponsors in PI?

Do you know how much advance time they give you for the visa interview? Example, they tell you in May that the interview is in July (so like a two month warning)

Close relationship for a k1, same as the rest of the world for spouse.

Pre-pandemic NVC provided about 6 +/- weeks for a spouse ( but can be rescheduled if needed).  Visa applicant schedules k1 interview.

not sure on the official policy but we had our interview a few days ago and no documentation was ever asked for or looked at. We gave the Ds-160 and they took off the receipt but that was it. In and out in about 15-20 minutes.  Never looked at the I-134, pay stubs, bank statements, employment letter, 3 years of tax returns, brokerage accounts, retirement accounts and on and on.
