the aos seemed to be illegal and unfeasible.

Groups and even attorneys are sometimes wrong.......in your case, adjustment of status is completely legal...

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yeah that's something I've seen, they al have weird theories like I've been told that changing my fligh to a later date would have been fraud.

Thank you anyway, a lot. it's reassuring.

If you want to get married do it. I would get married, go get your dependent ID (this will be your official US government ID from then on), sign up for Tricare, join Aviano military spouses page and ask if someone is willing to fly to bring your dog back with them when they PCS back to the states. If your fiancée was based there he should have some contacts he can talk to. If you do go back to Italy you can get a job on base and since Italy is super umm... *particular* about who works on base you will easily get a job since you are a spouse and I assume Italian. Also depending who your husband knows you might be able to get some of your items shipped back to the US with their house hold goods when they move back to the US.

Since he is military he will get more BAH after y’all get married. Immigration isn’t cheap, do that first, get your military documents in order, then decide what your next step is.

Thanks for your suggestions!! I will ask about the dog, that seem a great solution.

I have the ID ready and it's not the temporary one, he enrolled me yesterday in tricare.

That is a great start!   I love Tricare.  A copy of your ID card and a Tricare coverage letter are good pieces of marriage evidence.

There is one more thing. When Covid calms down your husband might be able to Hop a military flight and pick up your dog. Scheduling a military flight is hard to plan but can work. The Facebook page JBSA Lackland // JBSA Randolph Passenger terminal Facebook page post space A flights. They haven’t flown hops in a while but keep a look out on it.

From what you have posted, you can legally stay and adjust status.  Just be aware of the work and travel restrictions (6-8 months) associated with adjustment.  It is not illegal, and there will be no issue at AOS.

EAD & AOS are currently taking way longer than 6-8 months for AOS from b2/vwp.... many of us who filed back in March/April are still awaiting biometrics and depending on your local office it can now be anywhere up to 32 mths for gc.

AOS Journey

  • I-485 etc filed 23 April 2020
  • NOA1 I-485 June 3 2020
  • NOA1 EAD 23 April 2020
  • Biometrics 5 Jan 2021
  • EAD approved 12 March 2021
  • Interview Completed 24 March 2021
  • EAD Card Received 1 April 2021
  • Case under review 2 April 2021

Such Lawyers should be reported to their Bar Association, this is very basic stuff, at least you know not to use this Lawyer.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

we are in San Antonio, same lawyer told us it's 1 yr/1 yr and half waiting on the average

That part is true.  Current estimate for I-485 processing at the San Antonio field office is 12 to 18 months -- https://egov.uscis.gov/processing-times/

I am a bit dull but I need to understand how it work when it comes to the status I will be in, it we procede with AOS from an esta since I'm still on time to get back.

The idea is to file before my authorized stay expires but I'm not sure if it will be entirely possible or if it will be received on time.

What happen in that case? Will I be subject to deportation (if I don't do anything unlawful) until I have the receipt or until I get a green card?

Will I still be at risk to get nearby the border, even with a I-131?

I'm honestly confused.
