Hello,

I came to the US on a k1 visa got married and applied for AOS and EAD. I then got a job. My K1 visa will expire soon.

My question is can I keep working while hoping to get my EAD or must I quit when when I-94 expires?

If I continue working what kind of problem could I face with future dealings with USCIS because of that?

I will really appreciate it if any who has been in a situation like this or has an idea of what I could face could help me with any information.

As a practical matter it's up to your employer as to whether or not you can keep working between the time that your K1 EA expires and you have new EA as an applicant for adjustment of status.

You shouldn't have any problems with the USCIS if your employer does keep you working. The employer might have some problems with ICE if they get audited.

An extension is not possible. New EA on a different basis is requied.

Just get an extension to cover all bases.

Where can one find that information in the USCIS rules and regulations? Sorry but illegally working during the AOS process doesn't sit well with me.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Its in the Immigration and Nationality Act Section 245(c )(2).

To paraphrase: You will be denied AOS for illegally working, unless you're the immediate relative of a US Citizen. As a spouse of a US Citizen, you are an immediate relative, so they cannot deny your AOS for illegally working.
