Hello, I would really love some help as we are VERY anxious and nervous. My husband has an interview on Dec 9! We know he will be asked about this and I was wondering if this will get us denied :(

 

He was NOT removed, BUT refused admission to the USA on the visa waiver program in 2019 and returned to the UK same day.

 

So basically he was in USA at the time, we went home to UK to visit his family. On the way back he was pulled to be interviewed at airport. They went through everything and had him for 2 hours for questioning. They said he was NOT banned, but he did not have proper visa and would need  to go back to UK ( which they put him on the next flight in the same day so he never left airport). He went home and applied for a different visa in which he was DENIED that one too, which we then decided to get married and file for CR1. so he has been in UK since then.

 

I'm really hoping this doesn't mess up our chances of getting approved....does anyone have any experience on  this? Thank you!

It won’t have an impact as he wasn’t removed, he was just given the opportunity to withdraw his request to enter and was sent home. It does sound, from what you have written, that it could have been justified too. You say “he was in the USA at the time and we went back to the UK to visit his family”. This implies his main residence was in the US and he was just making a visit to the UK and didn’t actually live there. That’s not what the VWP is for. It sounds like he was misusing it to live here on 90-day installments with quick visits out of the country in between. 
 

It’s all water under the bridge now and won’t affect the CR-1.

from friend experience who he himself had even worse reason to get denied entry to US in 2011, his VISA was approved in 2017

 you have no problems at all so no worries and good luck!!

also could please let me know how long did it take from DQ to interview day? Thanks

Thank you so much!! To be honest I don't know our EXACT dates because it took so long. But we DQ early July of this year and interview id Dec 9! But overall we began this process 1.5 years ago, so our story isn't very happy :(

Oh my gosh!! I am so sorry that took SO long!! I was thinking our situation was taking so long because I've seen others getting interviews and approved way before us! Thank you so much and we will keep you guys in our thoughts. Praying for good new for you two!!!

Hi,

 

I’m in a similar situation and also nervous. I was denied entry to the US and my esta was revoked when I tried to visit my husband (then boyfriend) in 2019..because I was unemployed at the time and living at home with my parents basically I couldn’t prove strong ties to Ireland and they didn’t believe I would return 😔 thankfully though I didn’t actually board the flight as CBP is at Preclearance at Dublin airport...I did go to the embassy to try and obtain a visitor visa so I could visit but that was denied too for the same reasons. 
 

Fast forward to today, I have full time employment with an American company remotely from Ireland and we are married and filed our I-130 in September..I’m super anxious about my denial affecting our CR1..I won’t even attempt to visit him during the process.....I get flashbacks to how I was grilled by the CBP officer and worried that even if I am granted a visa they will question me at the POE 😩

 

 

I’m happy to hear everyone’s responses so far though 💕

Oh thats horrible. So sorry you had to go through it too! so far all the responses have given us hope. His interview is dec 9th, so praying for a good outcome. Check back after interview date to see if we made it!!!! Sending lots of love, I know how difficult the process is 😭

When I read about other people in this situation my mind thinks rationally about it 🙈 I think you are going to be just fine and I’m so excited that you’re at the last step of this crazy journey ❤️❤️❤️
