yes I have been here for a while they was denied for a tourist visa.

Simply I am trying to get them here. I want to do like anyone else and be smart about my decision.
I would like to do more than anyone else. I miss them.

I got it now.

The forms does not interfere for each other. Do you think the embassy will even know that they are waiting for the I-130 form.

It might be obvious for the embassy that they will come with a tourist visa and stay here.

Do you know what I mean?
I mean, are they still able to come with a tourist visa even when they have pending I-130.

Why they even denied for the tourist visa? It is sad that I can not get my family here even for a visit.

Has anything changed so they would now qualify to visit?

For visits, it might be easier for you to go there.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That is why strong ties to her current country is important. And as already mentioned, if your sister overstays tourist visa there is no path to Green Card because siblings don't meet the INA's limited definition of "Immediate Relative." https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-3

An alien is barred from adjustment of status if the alien is in an unlawful immigration status on the date of filing the adjustment application.

Well if they were denied already, what has changed in their situation? Unlikely they will be granted without a significant change.

Unfortunately that is a negative consequence of immigration...leaving family behind. It’s tough, we can all sympathize...

If they even sniff she would use a tourist visa as a pretext to apply for asylum there is no way they’d give it to her. And don’t fool yourself, the asylum process is long (can be years), arduous, stressful, and with no guarantee of success.

Remember- Entering the US via a non-immigrant route with the intent to stay and adjust status is fraud.

You are sounding really desperate.  

This is a legal path for your sister to immigrate through you as a sibling.


If you want to take chances by having your sister misuse a visitor visa to claim asylum, you may not like the consequences.
