Hi,

 

I am currently on H1B. My wife and I have been together for at least 6 years and we got married a few months ago. We both are PhDs. I kinda finished my application, but then I thought maybe my company would cover the cost and will give me some legal advise on some questions I have about my application. It turns out my company will cover the cost for both filing and legal part of it. But it seems the company's attorneys would file my application.  I would prefer to file it myself, since my case is very straight forward without any issue. So I was wondering if there is any downside (negative point) if a lawyer files my application rather that me. 

I'm asking this because somewhere I was reading it's better not to get a lawyer for marriage-based green card, in case your case is simple (i.e no over stay, no arrest, ....)

Just my opinion but from what i read on here

we say do it yourself as lawyers are costly and we like to save the expense

 

but if your company provides and pays the attorney ,  why not go that way

just make sure before you sign any application or papers for immigration that you have read them completely and they are 100 % perfect with nothing left out

and there are no misrepresentations.  you are the one ultimately responsible for the context of the application

From an H1B visa it sounds about right.  I say let them pay and have the attorney do it.  You'll be signing so read everything thoroughly.  Nobody can file for you without your involvement because they need to get a lot of information directly from both of you.

Just to clarify, marriage based green card typically costs less for companies than applying for employment base. I am not sure if all companies would support marriage based green card (being married to a US citizen). As you may know, when your company wants to apply for employment based green card, they need to post the job offer (the one you were hired for) for a year. And they need to show there is no US citizen that can do the job offered to you. If a US citizen applies for that job, and he/she is qualified, they need to go all the way to interview. This formality costs a lot for companies and has a lot of hassle. This is based on my understanding of how employment based green card works. So I'm not surprised companies would support marriage based green card.
