K1 Visa Processing in Lagos Nigeria

Timeline

Hello,

 

I was told everything was on hold for processing interview due to Covid19. I have seen people traveling in and out of Nigeria.

What's the hold on K1 at US Consulate Lagos?

USCIS approved April 2020 from California.

NVC still pending approval at this time and not ready for interview yet.

DS160 was completed a few months back. 

 

What can we do now to expedite or get help somewhere to get my husband here in the USA? 

Hire a lawyer? Talk to Nigerian Immigration? American Immigration? 

 

Please guide me. Thank you.

Are you married?  If so, your husband cannot get a K1 visa as K1 is only for applicants who are single.

 

If you are not married, I suggest you do not refer to your fiance as "husband".  We have seen cases here on VJ of K1 visa denials due to suspicion of being already married.

Go directly to your embassy's webpage to keep checking for information regarding operating status and any further updates. 


Also, DOS has issued a memorandum that K-1 Visas are now a high priority so that is no longer the problem.

The file will not move from NVC until such time as the embassy ask for them. There is no expedite or a lawyer that can circumvent this condition when a file is at NVC and the embassy is not interviewing because of the coronavirus (COVID-19) pandemic.

 

As stated by others, do not refer to your fiancé with a K-1 visa pending as your husband if indeed you are not married. If you are married, then you have filed the wrong visa application and you need to backtrack and submit a CR-1/IR-1.

US embassy in Lagos right now are processing only spouses and children of U.S citizens cases and some student/work visas. Nothing on K1 yet, hopefully by January they will include other visa categories

No, not married. I am just used to calling my fiance as husband and he calls me wife. The wedding is paid for here in the USA just waiting for him to arrive so we can get married.

I recently went for my interview and all other interviews scheduled so far that I know of are those categories of visa. Nothing yet on K1. You don't need to get a lawyer, you just have to be patient. Hopefully by January they will start conducting interviews for K1.

K-1 hasn't been forgotten. Your embassy is slowly opening but others have resumed adjudicating the backlog.

It might get denied in Nigeria. If it does get married in Nigeria.... never do a k1 with Nigeria... nigeria will deny it.

Not a stellar idea.  People have been denied a K-1 for doing things like this.  The wedding is paid for here in the USA just waiting for him to arrive so we can get married.  Also not smart to pay for the wedding without having any idea of when he may arrive.  Hopefully the money you have paid can be applied to subsequent dates.  With the Nigeria ban and COVID-related backlog, you may be looking at close to end of 2021 before he can get here.

You're doing others a disservice by stating that Nigeria will deny a K-1 visa. There are many who have received visas, one was approved in Sept and entered the US in December. If you use the tools that are available here on VJ*, you would be able to ascertain if your statement is true. Yes, some get denied but that happens at every embassy.
