I have a question for I765. I don’t know how to answer this. 27. Eligibility Category. Refer to the Who May File Form I-765 section of the Form I-765 Instructions to determine the appropriate eligibility category for this application. Enter the appropriate letter and number for your eligibility category below (for example, (a)(8), (c)(17)(iii)). My spouse is a J1 visa and I cant find which letter and number she would fall under.

 

Im like 90% done right now I’m gathering evidence and necessary *proof* documents that the checklist recommends. I am following this format and also reading the instructions for each form has.

 

 

 

My last question would be when I file for AOS, paperwork is accepted and I received notice its been accepted, does my spouse need to continue working for the host mom? Does she need to finish out her contract? I have read through this website but im still confused whats allowed and what isn’t in this regard.

Since you are submitting an i485 due to marriage the i765 category is c9.  J1 is not relevant

Your category is (c)(9). Make sure to read all the instructions and understand them very well before finalizing your forms. I know it's a lot of instructions to go over but you wouldn't want your packet to be sent back to you for choosing a wrong category or something like that.
