i751 waiver interview in Chicago - pending decision

Hiii everyone.

Pending decisions after an interview is so stressful so I thought why not post here and share this with you guys.

So I have recently interviewed (12 days ago) for i751 divorce waiver based on good faith marriage. My lawyer was present via telephone and we added Abuse (mental cruelty) + hardship waiver while I was there. My interview experience was alright but my lawyer told me ‘I gave A LOT of info’ as I went into the detail of why it ended. My emotions do overtake me when I explain that as it was an extremely hard time for me. The office heard me out and just asked basic questions for verification purposes and said how they will mail me or my lawyer if they need anything from me and will get back to us in 1-2 weeks as they need to review the case.
I read an expert mention here to a post how adding a ‘hardship’ waiver can be problematic. My attorney is good so I would like to think they know what they’re doing. Anybody here have any idea how long they take to respond after an interview?

Also does anyone know what’s going on with their online and automated phone response as it’s stuck on ‘my case is ready to be scheduled for an interview’ even though I have completed the interview.

I believe they gave you a piece of paper with some info and something like you should expect a response within 60 days. Long story short, there is nothing you can do. Most likely the application on the supervisor desk waiting for a signature either for approval or denial.

Checking both hardship and good faith marriage together is not smart, and most likely they ask you in the interview if you want to drop one. Hardship applications are hard to prove and/or harder to approve and require more detailed proof. So, I am not sure why your lawyer felt the need to add this? You could have just went with good faith and added the abuse proof to make a better case.

You case app may never be updated, so all you have to do keep an eye on your mail for official letter. I hope you get approved and I don't want to scare you but It is possible they deny your case because you couldn't prove the "Abuse" unless you submitted psych evaluation and police reports even if your case for good faith is good. So, hopefully you already covered that.

Good luck
