I'd say almost never it takes LESS than 24 months since filing date to get your GC, so yes, it's normal. I filed December 2017, PD December 2016.

Is your spouse a US citizen? If so then file VAWA as soon as you can and with application include EAD under C09 category. It should get approved after 3-6 months. I believe your old EAD will still be valid unless you I485 is denied, but double check with someone else on that one. With your VAWA package include a receipt for your "marriage" I485 and include a signed letter asking to hold that same I485 for your VAWA application.

You also need to start visiting a therapist asap, best to have at least 6-8 sessions and then ask them to write you an evaluation for 8 pages or so with your diagnosis (depression, PTSD etc). I think it's worth it. We did see some people get approved without police report of evaluation, but 2 years from now if they request abuse RFE you don't want to be stuck not knowing what to send.

Hi! I have similar timeline, but I am in NYC.

Feb 2019 - filed i360 (i485 was pending from before)

may 2020 - ead C31 under vawa
Aug 2020 - vawa approved

 

since then nothing, No Rfe and NO updates for i485 at all
 

my lawyer says it could be another 6 months to a year here in NYC 😒

Hi Friends! So for my interview this week I'm trying to prep any possible papers they may request, and I remembered that a few years ago when I worked as a bartender I got a few tickets under my name for some stupid reasons like not enough fire exits at the bar I worked at etc. I went to court with a lawyer and they all got dismissed right away. So when an officer asks if I ever received citations I would have to say yes, after that could they possibly ask for proof of those being dismissed? It was NYC, I've been trying to check online, but can't seem to find anything under my name, might be looking in the wrong place.

Tickets like the one they got dismissed is had to stay on record, after they’ve dismissed your ticket, you can get the disposition (records) in 3 days, after 6 months to a year I think, they won’t find any records in the system, if I were you, I wi go to the court for my disposition first, to see if the records is gone, they’ll still give you something to prove there’s no records, that way you can show it to the officer that there is no records.

Thanks! That was in 2016, and since then I have moved to a different state. I did submit New York police clearance obtained in 2017, and then FBI clearance for RFE in 2019 due to the move, none of them showed anything. Do you know if I can do that online? I see there's an option to request criminal records for $95, but I'm not totally sure that's what I need and they also don't show how long it will take them to give me a report.

No, I don’t know if you can do it on line , For the best results go to the court house, it’s only gonna  take less than one hour, but you have to go there early in the morning.

But I can only do it in the local court where it happened, right? This was in NYC, and I now live in Houston, TX.

Yes,  it has to be the same court house.

Although I doubt the IO is going to ask about that citation. To me, it falls under the same category as a speeding ticket.  They don't bring that up unless it involves a crime and/or an arrest. 

 

If they ask about the citation,  just say it like it is, if they need proof they will RFE you and you can figure it out then.

 

Just think of a smooth interview and focus on that. Avoid the negative scenario, that can mess you up.

Hi . Please can you explain further. I have an ead that would soon expire. I met a lawyer on Monday and she said i have to file another one and pay 1260k, please if you can explain very well how you were able to do it? I am really trying to save because I will have to get my own place in Houston plus do lots of paper work. So should the lawyer write uscis to apply the pending i485 to my vawa case so in that way I don't pay another fee?
