Yes .You must attend the inteview. Tell the officer that you will file VAWA,and ask him to put on holder your AOS.

It doesn't exist what your abuser is saying. Don't worry about it. You should not have any contact with your spouse anymore.Cut all ties.When your VAWA was approved the USCIS issued you " deferred action", it means they can't initiate removal proceedings.

You need to attend therapy at least 5/7 sessions and have a psychological evaluation done. If you have a diagnose of depression and/or PTSD then you can prove abuse. I had several cases approved with zero commingling finances. Get police clearance from al places that you resided for more than 6 months in the past 3 years.When you have these documents ready let me know and I will help you  at no cost (I am an attorney), but I need to be convinced that you have a VAWA case tho.

This information is wrong, as long your I-485 is pending you can apply for work permit and advance parole.The rule not to deport someone if the I-485 is denied is not valid anymore.

The best way is to file the motion jointly.But you can't file again if she filed already.Ask her a copy of the motion.

Am  about to submit a new I-765 (C9) (my spouse is a USC. I have the following documents ready;

1. I-765 category C9 ( what is the correct category C(09) or C(9)

2. I-912 - fee waiver form ( I got a waiver for it the first time and it was noted on the I-485 receipt. 

3. copy of the receipt - I-485 Pending

 

please house, particularly members who filed recently, what are the other documents I need to submit with the above.

 

do I need passport photographs and also copy of ID?
 

You kind assistance is urgently needed. Please note that the first I- 765 (C31) was done by my attorney.  Since she has refused to file the one based on C9, I decided to do it myself.

Thank you @Engineering-rocks I always think of the worst that may or may not happen and just because of what happen in the past and the bad exp. with my attorney thats why i always have that fear hope everything works out because if they decide to genie me or deport me i have nowhere else to go all the people that care about me are here. and maybe thats why he was putting all that fear in me my saying if i don't listen and do as he says i will suffer the consequences

Thank you @Stillwinning!!!😊you are the kindness person i know and your words are always such a blessing and full with hope and positivity. The only concerns that i have is that citation that is taken care of and the issue with the wrong DOB on my marriage certificate and that i wont be able to fix it on time since the marriage bureau is closed until good knows when. The reason why i didn't know about is that when i run away from my ex he toke all our joint documents and my personal once and shredded to pieces. But i hope that the IO will understand.

In general, deferred action means that a case will be looked at or resolved later, rather than now.  As Sandra has said, when your VAWA was approved, the USCIS issued you deferred action, meaning that they can't initiate removal proceedings.  You can stop worrying about being removed.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

My Domestic battery charge case was dismissed today. I have time to respond RFE to USCIS before 1/31. My third attorney was the best and really did great job in my case. I am grateful for all of you who were help me and cheering me up .
