Yayyy you are mu Vawa twin, i'm also feb 2020, also in houston. I pray we hear something good towards the end of the year. Funny how they let you do your fingerprints in 2020, but I just did mine on monday lol

Thanks. Actually, I was supposed to do ASC in March 2020. It was cancelled due to Covid, late, I sent the original letter to Vermont for rescheduling and I got another letter for October 2020.

what is the status of your application? Any approval yet on I-131 and I-765?

C31 EAD doesn't come as a combo, so parole will always be processed separately and arrive as a paper rather than card. Was your spouse a US citizen or a gc holder? If he/she was a citizen then you should submit another EAD application and put a category C09. It is free of charge and you can have it while you wait for VAWA approval. If he/she's a gc holder then yeah you can receive paper parole and wait for C31 EAD after VAWA approval.

Thanks for your response. I really appreciate. If file another I-765, will then give me another receipt number ? Also, what is processing time for I-765 (C09).

You're welcome. Yes, new receipt number. Check online a list of documents you need to file with your application, it needs to be sent to Vermont Service Center. I'd say 3-5 months on average, but there have been people with weird timelines like 2 months or 8+ months, not too common though.

Hello my beloved family,

Hope you all are doing great and being safe.

Good news!!! Today my attorney received notice for I-485 interview on 19th Jan, 2021 at 7.00am :)

It's been such a long waiting time and finally it arrived without any update online, I have been keep checking my status but it didn't show any update.

So it's quite a bit of pleasant surprise to me, I am happy and going to get myself all prepared for it.

I have only one question that notice says "REQUEST FOR APPLICATION TO APPEAR FOR INITIAL INTERVIEW", anyone has any idea why it says "INITIAL INTERVIEW"? Why not "Final Interview or just on Interview? Thanks.

It's just what they call it, initial because it's the first (and generally only). There are some cases where there are follow up interviews, but those are limited to marriage fraud interviews (also known as Stokes interviews).

Contradictions without citations only make you look dumb.

Hello. It will be 3 years since filing my VAWA case, my receipt date is February 5, 2018, and my most recent prima facile expires on March 7th. Who are good South Florida representatives to get help from? I have asked the office of Congressman Hastings but USCIS has not been forthcoming with that office.

My daughters and I haven’t had a work permit since 2017, which has made life very difficult for us and I just do not understand why they haven’t made a decision. This is all very frustrating for us. Also, is anyone able to help me write a personal letter of inquiry to USCIS? I did the online inquiry tool and heard nothing from that as well.

Hello my dear. I can really understand your pain. Nobody deserve to wait that long ( I’m waiting myself 26 months and a lot of people are in same situation). I tried to read all your posts and looks like you contacted ombudsman as well. Did you receive any feedback?
here the email my lawyer had used to inquired with USCIS hotlinefollowupi360.vsc@uscis.HD’s.gov

Her email was really simple.

subject: case follow up

Hello, we filed Vawa petition in (Date) and it looks like we are past the processing time. Can you please update us on the status of the case?

Regards,

Now, I can’t tell you if this is the best way you have to reach them out but I at least received an answer in metter of days.
I’m now thinking to inquire with my Senator with a more detailed and sentimental letter but I’m not even sure if it’s okay to do so. Having a meeting with my lawyer on Monday.
I’m sure you would received tons of other recommendation  from our family here! Stay strong and big hugs to your daughter.❤️

Dear,

I totally understand your position. It’s hard to raise kids yourself, let alone without a job.

Get some public aid with PF while keep pushing your case with different sources.

Stay safe and have faith.

@Villanelle   Thank you for you help and more than convincing reply.Yesterday my attorney sent me a email explaining that before the withdrawal of I-130 he filled paperwork/petition to INTERFILE I-485 with I-360.As per her version, the USCIS had to deny inter-filling petition, before denying I-485.  He further says that on the basis of inter-filling process, USCIS denied I- 130 but sent the file with pending I-485 to VSC. Today she filled case enquiry and she is 110 % sure my I-485 is still pending.

It won't be out of place to let you know that he didn't charge me a penny to file my Petition I-360 and  is in the practice for the last 22 years, and in such situation I cant argue with her.

But please you guide me is there any inter-filling process to attach AOS with other petition? and should I wait or file anew I-485  right now. Thanks

Your question is very specific but because I am not an attny and have very little knowledge about such interfiling strategies an attny may use  I suggest you ask for Sandras input by tagging her in a new post here that outlines exactly what is going on with your case. List it all out chronologically - dates and forms filed and any outcomes or actions taken. It will make it much easier for her to give you input as she most likely does not have time to review your post history and piece together your story.

From my understanding though "interfiling" is discretionary but if it was requested and approved properly then your 485 would still be pending.

Made the final call to uscis today. The rep said I am not eligible to get I-551 stamp in the passport. The reason is that only those who renew green card, remove conditions from green card or applying for citizenship with expired green card - can get the stamp. Is it a BS or are they right? I asked from different angles and got the same response. The rep seemed to be knowledgeable. The rep said though that one can present approved I-485 letter to employer and it will work just fine.

All the above is new to me and a bit shocking. Please let me know your thoughts.

Any updates on your card being mailed yet? Has your employer asked for updated I-9 info yet? I did a bit of searching and it seems for I-9 purposes you can show the 797 NOA but for doing so in the reverification process it only gives you 90 days (to then present the actual document). You may also need additional documents from the other lists that I dont know if you have or not. Have you reviewed the applicable webpages about everify and I-9 ? If not definately read them over. They list out various documents in List A, B, and C categories and the specifics of what combo of stuff needs to presented and when. If you are still unsure I would suggest posting in the main forums- there are a few users who are very knowledgeable about this topic that can probably help you who do not read the VAWA thread.
